JCISEF'H CDUNT`r' <br />REC~ihl?EFL <br />RESOLUTION OF THE SOUTH BEND REDEVELOPMENT C~1Vt`I~II~SIdN <br />MODIFYING AND AMENDING, AND CONFIRMING, AS MODIFIED AND <br />AMENDED, A RESOLUTION ESTABLISHING A HOUSING PROGRAM AND <br />A HOUSING ALLOCATION AREA IN THE NORTHEAST NEIGHBORHOOD <br />DEVELOPMENT AREA AND AMENDING THE NORTHEAST <br />NEIGHBORHOOD DEVELOPMENT AREA DEVELOPMENT PLAN <br />WHEREAS, the South Bend Redevelopment Commission (the "Commission"), <br />the governing body of the South Bend Department of Redevelopment, at a meeting held on <br />June 19, 2007, approved and adopted its Resolution No. 2344 entitled "RESOLUTION OF THE <br />SOUTH BEND REDEVELOPMENT COMMISSION ESTABLISHING A HOUSING <br />PROGRAM AND A HOUSING ALLOCATION AREA IN THE NORTHEAST <br />NEIGHBORHOOD DEVELOPMENT AREA AND AMENDING THE NORTHEAST <br />NEIGHBORHOOD DEVELOPMENT AREA DEVELOPMENT PLAN" (the "Declaratory <br />Resolution"); and <br />• WHEREAS, the Declaratory Resolution established a housing program in the <br />Northeast Neighborhood Development Area (the "Area"), designated as the "Northeast <br />Neighborhood Development Area Housing Program" (the "Housing Program"), designated and <br />declared a housing allocation area within the Area as the "Northeast Neighborhood Development <br />Area, Allocation Area #2" ("Allocation Area No. 2"), and amended the Northeast Neighborhood <br />Development Area Development Plan entitled "Amendment to the Northeast Neighborhood <br />Development Area Development Plan" (the "Plan Amendment"), all within the meaning of the <br />Redevelopment of Cities and Towns Act of 1953, as amended, which has been codified in <br />Indiana Code 36-7-14 et. sew. (the "Act"), said boundaries of the Housing Program and <br />Allocation Area No. 2, being more particularly described in Exhibit A attached hereto and <br />incorporated herein; and <br />WHEREAS, certain Findings of Fact have been presented to the Commission <br />which concern the location, physical condition of structures, land use, environmental influences <br />and other conditions of the Area, specifically related to Allocation Area No. 2 in which the <br />Housing Program will be located, and the Commission now desires to adopt and confirm those <br />Findings of Fact; and <br />WHEREAS, the St. Joseph County Area Plan Commission (the "Plan <br />Commission"), which is the duly designated and acting planning body for the City of South <br />Bend, Indiana (the "City"), on June 19, 2007, adopted a resolution, which is its written order <br />approving the Declaratory Resolution and the Plan Amendment; and <br />I3DDB01 481 1822v3 <br />
