• EXHIBIT B FINDINGS OF FACT All findings in the original Declaratory Resolution No. 919, adopted by the South Bend Redevelopment Commission (the "Commission"), on February 23, 1990, as amended (the "Declaratory Resolution"), shall remain, unless otherwise found to be inconsistent with the findings as provided herein. In accordance with IC 36-7-14 et. se . (the "Act"), the following additional findings are hereby made, which relate to the Amendment to the Airport Economic Development Area (the "Airport Area") Development Plan (the "Plan Amendment"), pursuant to Resolution No. 2348, adopted by the Commission of the City on June 19, 2007 (the "Resolution"): 7. The Plan Amendment for the Airport Area promotes significant opportunities for the gainful employment of its citizens. The Plan Amendment for the Airport Area cannot be achieved by regulatory processes or by the ordinary operation of private enterprise because of lack of public improvements or other similar conditions. 9. The Resolution and the Airport Area Development Plan (the "Development Plan"), with the proposed Plan Amendment, conform to the comprehensive plan of the City of South Bend (the "City") including other development and redevelopment plans for the City, and the Plan Amendment is reasonable and appropriate when considered in relation to the original Declaratory Resolution, as amended, the Development Plan and purposes of the Act. 10. The Plan Amendment for the Airport Area will promote the commercial growth of the Airport Area, as consolidated and expanded. 11. The public health and welfare will be benefited by the accomplishment of the Plan Amendment for the Airport Area. 12. The accomplishment of the Plan Amendment for the Airport Area will be a public utility and benefit as measured by the attraction and retention of permanent jobs providing solid wages and a thriving commercial employment base in the City. The findings for the part of the Airport Area comprised of the LaSalle Square Area are consistent with the original findings of fact for the Airport Area, and the Commission hereby additionally finds as follows for the LaSalle Square Area: The Plan Amendment for the Airport Area encourages commercial and industrial development, creates more job opportunities and increases the local tax base. • B-1 BDDBOI 480~884v2
