RESOLUTION NO. 2365 • RESOLUTION OF THE SOUTH BEND DREDEVELOPMENT COMMISSION APPOINTING THE CITY OF SOUTH BEND, INDIANA, BOARD OF PUBLIC WORKS AS AN AGENT TO CONSTRUCT CERTAIN IMPROVEMENTS TO MICHIGAN STREET RETAIL AREA NO. 2 (South Bend Central District Development Area) • WHEREAS, the South Bend Redevelopment Commission (the "Commission" is the owner of property located in the South Bend Central District Development Area in the general vicinity of 129 S. Michigan Street in the City of South Bend, Indiana (the "Property"); and WHEREAS, in order to improve the Property to a condition acceptable to lease it to a prospective tenant, the Commission intends to undertake certain improvements to the Property, including the improvements set forth at Exhibit A (the "Improvements"); and WHEREAS, the Commission desires to appoint the Board as its agent for purposes of receiving and awarding bids for Improvements and overseeing their constriction and completion; and WHEREAS, the Board is willing to accept such appointment to facilitate the reuse of the property; NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND REDEVELOPMENT COMMISSION as follows: 1. The Commission hereby appoints the Board as its agent for purposes of bidding and awarding a contract for the construction the Improvements, described at Exhibit A, in an amount not to exceed $2,400.00, which process shall occur in accordance with Indiana Code 36-1-12 and other applicable law. The Commission further appoints the Board as its agent for purposes of monitoring and overseeing the construction and completion of the Improvements. 2. This Resolution shall be in full force and effect after its adoption by the Commission and upon it acceptance by the Board. **~~ n U
