refunding of the BANs, if issued, and all authorized costs relating thereto, have been complied <br />with in accordance with the provisions of the Act. The Common Council therefore seeks to <br />authorize the issuance of revenue bonds and BANS, if necessary, to finance the acquisition, <br />construction, and installation of the Project pursuant to the Act and the sale of such revenue <br />bonds to the Indiana Bond Bank (the "Bond Bank") pursuant to the provisions of Indiana <br />Code 5-1.5, the Indiana Finance Authority (the "Authority"} pursuant to the provisions of <br />Indiana Code 4-4-11 and Indiana Code 13-18-13, or at public sale pursuant to the provisions of <br />Indiana Code 5-1-11 and the sale of such BANs pursuant to the provisions of the Act and other <br />applicable laws, subject to and dependent upon the terms and conditions hereinafter set forth. In <br />conjunction with the issuance of any such bonds sold to the Authority, the City expects to enter <br />into a Financial Assistance Agreement (as hereinafter defined) with the Authority, pertaining to <br />the Project and the financing of a portion thereof; <br />NOW; THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF <br />THE CITY OF SOUTH BEND, INDIANA, AS FOLLOWS: <br />Section I. Acquisition Construction and Installation of the Proiect. The City, <br />acting by and through the Board and as the- owner and operator of the Sewage Works for the <br />collection and treatment of sewage and other wastes, hereby orders, authorizes and directs the <br />Board to acquire any and all necessary property and to proceed with the acquisition, <br />construction, and installation of improvements and extensions to the Sewage Works, pursuant to <br />the Act and in accordance with the plans, specifications and cost estimates prepared and filed <br />with the Board by the Consulting Engineers, which plans, specifications and cost estimates are <br />hereby adopted and approved and, by reference, incorporated fully into this Ordinance, and two <br />copies of which are now on file in the office of the Board and are open for public inspection. <br />-4- <br />BDDB01 5738468v1 <br />
