10:00 a.m. local time, at 1308 County-City Building, South Bend, Indiana, the Commission heard all persons interested in the proceedings and received and considered ~ written remonstrances and objections and other such evidence presented. NOW, THEREFORE, BE IT RESOLVED by the South Bend Redevelopment Commission, governing body of the City of South Bend, Department of Redevelopment, as follows: 1. The Commission finds that the proposed amendment to the Development Plan and to Resolution No. 818, as amended (including contracting the Area to exclude Reduction Area No. 2 and Reduction Area No. 3), is reasonable and appropriate when considered in relation to the Development Plan and to Resolution No. 818, as amended, respectively, and the purposes of the Act. 2. The Commission finds that the Development Plan, as amended, and Resolution No. 818, as amended and as hereby further amended, conforms to the comprehensive plan of the City 3. The West Washington-Chapin Development Area is hereby contracted to exclude Reduction No. 2 as described at Exhibit A and Reduction Area No. 3 as described at Exhibit B and the West Washington-Chapin Development Area, as amended, is to be known hereafter as the "West Washington-Chapin Development Area" and is described at Exhibit C. 4. The West Washington-Chapin Allocation Area No. lA ("Allocation Area No. lA") is hereby contracted to exclude Reduction Area No. 2 as described at Exhibit A and Reduction Area No. 3 as described at Exhibit B so that the boundaries of the Allocation Area No. 1 A and the West Washington-Chapin Development Area are coterminous. Any taxes levied on the property imposed under LC. 6-1.1 in Allocation Area No. lA shall be allocated, distributed and used as provided in Resolution No. 818, as amended, and the Act. The Allocation Area No. 1 A as contracted shall be hereinafter known as "West Washington-Chapin Allocation Area No. lA." 5. The proposed amendment to the Development Plan as attached hereto as Exhibit D is hereby in all respects approved. 6. The Secretary is hereby directed to file a certified copy of said Development Plan, as amended, with the minutes of this meeting. 7. The Secretary is hereby further directed to record this Resolution with the office of the St. Joseph County Recorder pursuant to the requirements of LC. 36-7-14-17.5(g). 8. All other findings, determinations, and conclusions in Resolution No. 818, as amended, shall remain as stated therein. 9. The United States of America is hereby assured of full compliance by the South Bend Redevelopment Commission with regulations of the Department of Housing and Urban Development effectuating Title VI of the Civil Rights act of 1964, as amended. • '
