SUBSTITUTE BILL <br />ORDINANCE NO. ~ ~QJ" <br />AN ORDINANCE OF THE COMMON COUNCIL <br />OF THE CITY OF SOUTH BEND, INDIANA APPROVING <br />PARKING RATES FOR PARKING GARAGES <br />OPERATED BY THE BOARD OF PUBLIC WORKS OF <br />THE CITY OF SOUTH BEND, INDIANA <br />STATEMENT OF PURPOSE AND INTENT <br />I.C. 36-9-11-7 authorizes the Boazd of Public Works to fix the rates and charges to be <br />collected for pazking vehicles in pazking facilities owned and operated by the City and for other use <br />of those parking facilities so as to promote the maximum use of the facilities by the public in a safe, <br />orderly, and efficient manner. Such rates fixed by the Boazd of Public Works are subject to the <br />approval of the Common Council. The Council has received Resolution No. 42-1997 of the Boazd <br />of Public Works, a copy of which is attached hereto and made a part hereof, which establishes rates <br />for city-owned parking facilities, both pazking garages and pazking lots. <br />NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of South <br />Bend, Indiana as follows: <br />SECTION I. The following monthly rates shall be charged to vehicles pazked at City <br />operated pazking garages: <br /> <br />(a) Per vehicle, on a month-to-month basis <br />(b) Per vehicle, on a three-yeaz contract <br />(c) Per vehicle, on a five-year contract <br />(d) Group rates on a monthly contract <br />(e) Group rates on a monthly contract for <br />rooftop pazking <br />$35.00 per mo. <br />$35.00 per mo. <br />$35.00 per mo. <br />$35.00 per mo. <br />$22.00 per mo. <br />(f) For purposes of Subsection (e), a group shall be defined as ten (10) or more spaces <br />leased pursuant to a single account. <br />(g) Priority for committing pazking spaces within a Ciry operated pazking gazage shall be <br />given to vehicles with the longest term parking contract and the highest monthly rental rate. <br />Commitment of spaces within a pazking gazage within a particular rate structure shall be determined <br />base upon (1) the number of pazking spaces committed per single billing; (2) the length of time the <br />person has committed spaces within that garage; and (3) the payment experience of the account. <br />Persons entering into long term agreements for parking may be granted an option to renew <br />within the discretion of the Boazd of Public Works or its designee. <br />(h) The owner of any vehicle admitted to the garage pursuant to a rooftop group rate <br />
