~ tr t- . ~_ <br />RESOLUTION NO. ~ 2~ / L ~'1 ~` _i `'`"'` r, ~ ` ~. z-- <br />A RESOLUTION OF ~` ~ ~L < `_ (~ _ <~.. ~ <br />THE SOUTH BEND REDEVELPMENT CC _._ __ ~ _ . <br />ACCEPTING THE TRANSFER OF PROPERTY FROM <br />THE CITY OF SOUTH BEND BOARD OF PUBLIC WORKS <br />WHEREAS, pursuant to Indiana Code §36-9-6-3, the City of South Bend ("City") is the owner of <br />property located within the City of South Bend, St. Joseph County, Indiana, which property is more particularly <br />described at Exhibit "A" attached hereto and incorporated herein ("Property"); and <br />WHEREAS, in accordance with Indiana Code 36-7-14, et seq., the South Bend Redevelopment <br />Commission ("Commission") is the governing body of the City's Department of Redevelopment and is <br />empowered to acquire and dispose of interests in property; and <br />WHEREAS, the Board desires to transfer the Property to the Commission for use in a redevelopment <br />project located within the City and the Commission desires to accept transfer of the Property from the Board; and <br />WHEREAS, pursuant to Indiana Code §36-1-11-8, the City, acting by and through the Board, may <br />transfer the property to the Commission through the adoption of substantially identical resolutions by each entity. <br />THEREFORE, BE IT RESOLVED, by the South Bend Redevelopment Commission as follows: <br />Section 1. The transfer of Property more particularly described at Exhibit "A" by the Board to the <br />Commission is hereby accepted and approved. <br />• Section 2. The Director of Redevelopment of the City of South Bend is hereby authorized to cause <br />the recording of the quit claim deed conveying all right, title and interest in the Property from the City to <br />the City of South Bend, for the use and benefit of its Department of Redevelopment. <br />Section 3.
