Resolution No. 2 ~~,~~_ A RESOLUTION OF THE SOUTH BEND REDEVELOPMENT COMMISSION ACCEPTING THE TRANSFER OF REAL PROPERTY FROM THE CITY OF SOUTH BEND, INDIANA WHEREAS, the City of South Bend, Indiana (the "City") is the owner of the following described real property situated in St. Joseph County, Indiana: SEE ATTACHED EXHIBIT A (collectively hereinafter referred to as the Real Property); and WHEREAS, pursuant toI.C. 36-9-6-3, the Board of Public Works of the City of South Bend (the "Board") has custody of and may maintain all real property of the City of South Bend; and WHEREAS, the City, through the Board, desires to transfer the Real Property to the City of South Bend, for the use and benefit of its Department of Redevelopment for subsequent development and transfer to third parties as appropriate for use in the redevelopment of the Airport Economic Development Area; and • WHEREAS, the City of South Bend, Department of Redevelopment, acting by and through its governing body, the South Bend Redevelopment Commission desires to acquire the Real Property from the City of South Bend; and WHEREAS, pursuant to I.C. 36-1-11-8, the City, acting by and through the Board, may exchange or transfer property with another governmental entity upon terms and conditions agreed upon by the two (2) entities as evidenced by the adoption of substantially identical resolutions of each entity; and WHEREAS, the Board of Public Works, at its meeting of April 14, 2008, adopted its Resolution No. 18-2008, approving the transfer of the Real Property to the City of South Bend, for the use and benefit of its Department of Redevelopment. NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND REDEVELOPMENT COMMISSION AS FOLLOWS: Section 1. That the transfer by the City of South Bend, Indiana, of the Real Property situated in St. Joseph County, Indiana, and described at Ex/ribitA attached hereto and incorporated herein, to the City of South Bend, for the use and benefit of its Department of Redevelopment, shall be, and hereby is, approved and accepted.
