<br />GULAR MEETING JUNE 8, 2009 199 <br />NEW INSTALLATION: No Parking Signs <br />LOCATION: South side of LaSalle - 115' west of Frances Street <br />REMARKS: All criteria has been met -Restrict parking for South Bend <br />Clinic <br />FILING OF SAFETY REPORTS -DEPARTMENT OF PU3L1C___WURKS <br />The Division of Engineering and Water Works submitted their Safety Reports for the month of <br />May, 2009. These reports reflect injuries/damages for each month and provide for a comparison. <br />There being no further discussion, upon a motion made by Mr. Gilot, seconded by Mr. Murphy <br />and carried, the reports were accepted and filed. <br />FILING OF MONTHLY AND PERFORMANCE MEASURE REPORTS -DEPARTMENT <br />OF PUBLIC WORKS <br />The Division of Water Works submitted their Monthly and Performance Reports for the month <br />of May 2009. There being no further discussion, upon a motion made by Mr. Gi1ot, seconded by <br />Mr. Murphy and carried, the monthly report was accepted and filed. <br />RATIFY APPROVAL AND/OR RELEASE CONTRACTOR AND EXCAVATION BONDS <br />Mr. Anthony Molnar, Division of Engineering, recommends that the following Contractor and <br />Excavation Bonds be ratified pursuant to Resolution 100-2000 and/or released as follows: <br />Business Bond Type Approved/ <br />Released Effective Date <br />Pioneer Masonry, Inc. Contractor Release May 31, 2009 <br />D & B Plumbing, Inc. Contractor Release June 23, 2009 <br />Martell Electric, LLC Excavation Approved May 19, 2009 <br />McIntyre Jones, Inc. Excavation Reinstated May 1, 2009 <br />Mr. Gilot made a motion that the Bonds approval and/or release as outlined above be ratified. <br />Mr. Murphy seconded the motion, which carried. <br />APPROVE CLAIMS <br />Mr. Murphy stated that a request to pay the following claims in the amounts indicated has been <br />received by the Board; each claim is fully supported by an invoice; the person receiving the <br />goods or services has approved the claims; and the claims have been filed with the City Fiscal <br />Officer and certified for accuracy. <br />Name Amount of Claim Date <br />City of South Bend $1,965,497.40 6/08/09 <br />St. Joseph County Housing Consortium $11,920.58 5/27/09 <br />St. Joseph County Housing Consortium $12,500.00 5/27/09 <br />St. Joseph County Housing Consortium $1,460.00 5/27/09 <br />St. Joseph County Housing Consortium $6,751.42 5/27/09 <br />Therefore, Mr. Murphy made a motion that after review of the expenditures, the claims be <br />approved as submitted. Mr. Gilot seconded the motion, which carried. <br />PRIVILEGE OF THE FLOOR <br />Mr. Murray Miller, Local Union Leader, questioned the Board whether their attorney had <br />reviewed the law on preference of bid awards to contractors in the state of Indiana, versus <br />outside of Indiana. Mr. Gilot stated their attorney had not had a chance to review the law, but <br />from what he had read, he didn't believe it applied to the City; it appeared to be just a State <br />Statute. He explained that different entities are regulated by different laws. The State has their <br />own laws and cities are classified as first class, second class and third class with different laws <br />applying to each. <br />Mr. Miller stated the Union has been having problems receiving wage rates from certain <br />contractors. He asked what they could do to make sure the specs are being followed and what the <br />City is doing to enforce the requirements of the specs. Mr. Littrell noted they are conducting <br />periodic meetings to enforce the issue. Mr. Tom Frailey, Fair Foundation for Contracting, <br />introduced himself to the Board. He informed the Board that his business is for the purpose of <br />construction investigation. They look at contracts and monitor works sites to assure the bid specs <br />are being followed. If problems are found they go to the contractor directly to attempt to work <br />
