<br />ORDINANCE N®. <br />AIV ORDINANCE AIVIERIDINC3 THE ZONINC7 ORDINANCE FOR PROPERTY <br />LOCATED AT EDDY STREET AND ANGELA BOULEVARD/EDISOIV ROAD, <br />COUIVCILMANIC DISTRICT FOUR (4) IN THE CITY OF SOUTH BEND, INDIANA <br />STATEMENT OF PURPOSE AND INTENT <br />The rezoning seeks to further define the number of unrelated adults who may occupy a <br />dwelling unit within the portion of the previously approved Area 1 of the Eddy Street <br />Commons Planned Unit Development, to provide for a maximum of three (3) adults <br />unrelated by blood, marriage or legal adoption to live together in one (1) dwelling, with, <br />however, a further restriction providing for a maximum of two (2) adults unrelated by <br />blood, marriage or legal adoption to live together in one (1) dwelling unit that contains a <br />single bedroom. <br />NOW THEREFORE BE IT ORDAINED by the Common Council of the City of <br />South Bend, Indiana as follows: <br />SECTION 1. Ordinance No. 9495-04, is amended, which ordinance is commonly known <br />as the Zoning Ordinance of the City of South Bend, Indiana, be and the same hereby is <br />amended in order that the zoning classification of the following described real estate in <br />the City of South Bend, St. Joseph County, State of Indiana: <br />A part of the Northeast Quarter of Section 1, Township 37 North, Range 2 East and a <br />part of the Northwest Quarter of Section 6, Township 37 North, Range 3 East and Lots <br />26 and 27 and Lots 71 through 74 and Lots 107 through 110, .all in Hartman and Miller's <br />plat, the plat of which is recorded in Plat Book 7, Page 29, in the Office of the Recorder <br />of St. Joseph County, Indiana, and including all street and alleys lying within the below <br />described perimeter, all being in the City of South Bend, Portage Township, St. Joseph <br />County, Indiana, being more particularly described as follows: <br />Beginning at the Northeast Corner of Lot 35 in Sorin's second addition; the plat of which <br />is recorded in Plat book 1, Page 10 in said Recorder's Office; Thence N. 00°20'45" W., <br />(N. 00°20'42" W. Record), 70.11 feet to a point on the Southerly Extension of the West <br />Right-of-way line of Eddy Street and the Easterly Extension of the proposed North <br />Right-of-way line of Napoleon Street as shown in Vacation Ordinance Number 9818-08; <br />Thence along said proposed North Right-of--way line N. 88°57'46" W., 194.72 Feet to a <br />point on the Southerly Extension of the West line of Parcel 1 described in Instrument <br />Number 0117885 in said Recorder's Office; Thence along said West line, N. 02°44'02" <br />W., 512.14 Feet; to the South Right-of-way line of Angela Boulevard; Thence along said <br />South Right-of-way line, S. 78°02'36" E., 47.16 Feet; Thence along said South Right-of- <br />way line S. 89°21'11" E., 130.00 Feet; Thence crossing Eddy Street N. 88°23'14" E., <br />
