J ~ ~< ~~ STAFF REPORT June 8, 1998 Initiated by the Area Plan Commission 1824-98 Location: 2211 East Jefferson Boulevard City of South Bend REQUESTED ACTION: This is an Area Plan Commission initiated petition to zone from "B" Residential, "A" Height and Area to "PHC" Professional/Health Care to allow permitted uses in the "PHC" Professional/Health Care District. EXISTING LAND USE: The property contains an office building. SURROUNDING LAND USE AND ZONING: Located to the north is a condominium zoned "A-1" Residential, "C" Height and Area; to the east and west are single family homes zoned "A" Residential, "A" Height and Area; and to the south are a church and school zoned "A" Residential, "A" Height and Area. ACCESS: WATER SOURCE/SEWAGE DISPOSAL: DRAINAGE: SITE DATA: ENVIRONMENTAL DATA: SITE PLAN: Access to the site is from Jefferson Boulevard. Water and sewer are available to the site. The total site to be rezoned is 4.5 acres. A check of the Agency's maps indicates that no public wells, wetlands, flood or environmental hazard areas are present. AGENCY COMMENTS: In 1986, this site was rezoned from "A" and "B" Residential, "A" Height and Area to "B" Residential, "A" Height and Area to allow an office building. PRELIMINARY STAFF RECOMMENDATION: Based on information available prior to the public hearing, the Staff recommends that this petition be sent to the Common Council with a favorable recommendation, subject to the existing approved Final Site Plan. This petition would rezone an office that is a legal nonconforming use in the "B" Residential district to the "PHC" Professional/Health Care district. "PHC" zoning will make the office a permitted use, which would allow it to be rebuilt if destroyed.
