(b) The form of any Use or Development Written Commitment shall include but not <br />be limited to the following: <br />1. Legal name and address of the fee-title owner(s) of the subject property; <br />2. Legal description of the subject property; <br />3. Bill number assigned by the City Clerk to the proposed zoning or PUD <br />district bill; <br />4. Listing of the express conditions of the proposed rezoning of the subject <br />property including the current and proposed zoning classifications and <br />height and area designations, if any; <br />5. Statement that the owner(s) of the subject property agree to record in the <br />Office of the St. Joseph County Recorder at the owner(s)' expense the <br />written commitment once approved and provide copies to both the South <br />Bend City Clerk and the Area Plan Commission; <br />6. Statement that the owner(s) agree to comply with the terms, conditions <br />and provisions set forth in the written commitment; <br />7. Signature(s) of the fee-title owner(s); and if the entity is a corporation, <br />signatures of the corporate secretary and the date of such signing; and <br />Signatures of the President and Secretary of the Area Plan Commission <br />and the date of such signing and approval. <br />(c) A written commitment approved by the Area Plan Commission shall be recorded <br />in the Office of the St. Joseph County Recorder within seven (7) working days of the <br />Commission's approval. <br />(d) A written commitment approved by the Area Plan Commission shall take effect <br />upon passage of the amendment to the zoning ordinance or PUD district ordinance or <br />upon the granting of the approval of the commitment, whichever is later. <br />(e) Unless modified or terminated by the Area Plan Commission, a written <br />commitment is binding upon the fee-title owner(s) of the subject property, each <br />subsequent owner, and each other person acquiring an interest therein. <br />(f) Once recorded, a written commitment may only be modified or terminated by a <br />decision of the Area Plan Commission made at a public meeting after notice as provided <br />by rule of the Commission. <br />
