Amend Chapter 21, Article 7 - Zoning - the inclusion of new Section 21-130 entitled Use or Development written commitments

(b) The form of any Use or Development Written Commitment shall include but not be limited to the following: 1. Legal name and address of the fee-title owner(s) of the subject property; 2. Legal description of the subject property; 3. Bill number assigned by the City Clerk to the proposed zoning or PUD district bill; 4. Listing of the express conditions of the proposed rezoning of the subject property including the current and proposed zoning classifications and height and area designations, if any; 5. Statement that the owner(s) of the subject property agree to record in the Office of the St. Joseph County Recorder at the owner(s)' expense the written commitment once approved and provide copies to both the South Bend City Clerk and the Area Plan Commission; 6. Statement that the owner(s) agree to comply with the terms, conditions and provisions set forth in the written commitment; 7. Signature(s) of the fee-title owner(s); and if the entity is a corporation, signatures of the corporate secretary and the date of such signing; and Signatures of the President and Secretary of the Area Plan Commission and the date of such signing and approval. (c) A written commitment approved by the Area Plan Commission shall be recorded in the Office of the St. Joseph County Recorder within seven (7) working days of the Commission's approval. (d) A written commitment approved by the Area Plan Commission shall take effect upon passage of the amendment to the zoning ordinance or PUD district ordinance or upon the granting of the approval of the commitment, whichever is later. (e) Unless modified or terminated by the Area Plan Commission, a written commitment is binding upon the fee-title owner(s) of the subject property, each subsequent owner, and each other person acquiring an interest therein. (f) Once recorded, a written commitment may only be modified or terminated by a decision of the Area Plan Commission made at a public meeting after notice as provided by rule of the Commission.
