ORDINANCE NO. l 13~a <br />AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, <br />INDIANA, APPROPRIATING FUNDS FOR CAPITAL EXPENDITURES FOR THE <br />FISCAL YEAR 2009 FROM THE WATER WORKS DEPRECIATION FUND (#622) <br />AND THE SEWAGE WORKS DEPRECIATION FUND (#642) <br />STATEMENT OF PURPOSE AND INTENT <br />The City anticipates making a variety of capital improvements to its various facilities and <br />capital inventory during fiscal year 2009 and has determined that it is necessary and appropriate <br />to make payment of these expenses and to appropriate sufficient funds from the various capital <br />funds of the City to do so, and that it is in the best interests of the City that the same occur. <br />The specific capital improvements and expenditures the City anticipates making and the <br />capital funds from which appropriations are made to support those expenditures are identified <br />hereafter. <br />NOW, THEREFORE BE IT ORDAINED BY THE COMMON COUNCIL OF THE <br />CITY OF SOUTH BEND AS FOLLOWS: <br />SECTION I. The following amounts shall be and hereby are appropriated in the fiscal <br />year 2009 and ordered set apart within the following designated capital funds for the payment of <br />the expenses identified below, and in accordance with the detail attached as Exhibit A. <br />FUND AMOUNT <br />WATER WORKS DEPRECIATION FUND (Fund # 622) $1,107,100 <br />SEWAGE WORKS DEPRECIATION FUND (Fund # 642) $3,612,300 <br />SECTION II. If any one or more of the provisions of this ordinance or of the subparts of <br />the previous Section I shall for any reason be held to be invalid, illegal, or unenforceable in any <br />respect, such invalidity, illegality or unenforceability shall not affect any other provision hereof, <br />and this ordinance shall be construed as if such invalid, illegal or unenforceable provision was <br />not contained therein. <br />SECTION III. This ordinance shall be in full force and effect from and after its passage <br />by the Common Council and approval of the Mayor. <br />Member of the Common Council <br />
