ORDINANCE NO. U~ ~ I' ~ O <br />AN ORDINANCE TO VACATE THE FOLLOWING DESCRIBED PROPERTY: <br />SIX ALLEYS AND THREE STREETS IN HOMELAND 3RD ADDITION <br />AND RICHLAND 2ND ADDITION (PT VACATED) <br />Pursuant to Indiana Code Section 36-7-3-12, the Common Council is charged with the <br />authority to hear all petitions to vacate ways or public places within the City. <br />The following Ordinance vacates the above described public property. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY <br />OF SOUTH BEND, INDIANA, as follows: <br />SECTION I. The Common Council of the City of South Bend having held a public hearing <br />on the petition to vacate the following property: <br />STREET VACATION <br />Delaware Street from the west right-of--way of S. Kaley Street to the west right-of--way of Prospect <br />Street for a distance of approximately 326 feet and a width of 60 feet. Part located in Homeland 3rd <br />Addition, city of South Bend, St. Joseph County, Indiana. <br />Also, Kaley Street form the south right-of--way of Delaware Street to the north right-of--way of W. <br />Ewing Avenue for a distance of approximately 706 feet and a width of 60 feet. Part located in <br />Homeland 3rd Addition and part located in Richland 2nd Add.(pt. vacated), city of South Bend, St. <br />Joseph County, Indiana. <br />Also, W. Ewing Avenue from the west right-of--way of Prospect Street to the west right-of--way of <br />S. Kaley Street for a distance of approximately 326.8 feet and a width of 30 feet. Part located in <br />Homeland 3rd Addition, city of South Bend, St. Joseph County, Indiana. <br />ALLEY VACATION <br />The first north south alley west of Prospect Street from the south right-of--way of Delaware Street <br />to the north right-of--way of W. Ewing Avenue for a distance of approximately 706 feet and a width <br />of 14 feet. Part located in Homeland 3rd Addition, city of South Bend, St. Joseph County, Indiana. <br />ALLEY VACATION <br />Also, the first east/west alley north of W. Ewing Avenue from the west right-of--way of Prospect <br />Street to the east right-of--way of the first north/south alley north of W. Ewing Avenue for a distance <br />of approximately 126 feet and a width of 14 feet. Part located in Homeland 3rd Addition, city of <br />South Bend, St. Joseph County, Indiana. <br />ALLEY VACATION <br />Also, the first east-west alley north of W.
