Ordinance Addressing Tattoo, Body Piercing, Scarifying & Branding Establishments and Personnel <br />Page 2 <br />(c) The Council further finds and declares that current federal and state regulations <br />are wholly inadequate to address the growing public health and public safety concerns <br />caused by unlicensed individuals performing tattoo, body piercing and branding services <br />for a fee within our City. <br />(d) The Council therefore concludes that it is necessary to establish the following <br />regulations which are enacted to serve the best interests of the residents of our community <br />and are a proper exercise of the City's police powers granted to it. <br />Sec. 13-124 Definitions. <br />Any word that is not specifically defined in this section shall have the definition <br />assigned to it in Indiana Code §§ 16-18-2-1 through 16-18-2-379, as it may be amended <br />from time to time. The following definitions shall apply throughout this Article:l <br />"Acceptable" means satisfactory or adequate; fulfilling the needs or requirements of a <br />specified rule, provision or policy. <br />"Antiseptic" means a product or products used to stop or inhibit the growth of bacteria. <br />"Blood" means human blood. <br />"Bloodborne pathogens" means pathogenic micro-organisms that are present in human <br />blood and can cause disease in humans. These pathogens, include, but are not limited to, <br />the following: <br />1. Hepatitis B virus (HBV). <br />2. Hepatitis C virus (HCV). <br />3. Human immunodeficiency virus (HIV) as further addressed in Indiana <br />Code § 16-41-12-4, as may be amended from time to time. <br />"Client" means the individual receiving any service regulated by this Article. <br />"Contaminated sharp" means an object that meets the following conditions: <br />1. Is capable of cutting or penetrating the skin. <br />2. Has been in contact with blood or body fluids. <br />The term includes a hypodermic or suture needle, syringe, scalpel blade, pipette, lancet or <br />broken glass as further defined in Indiana Code § 16-41-16-2, as it may be amended from <br />time to time. <br />"Brand" means to mark the skin by utilizing a hot instrument or any type of contaminated <br />sharp instrument. <br />"Clean" means free of dust, soil, or other foreign matter. <br />
