as approved by HUD: provided, however, to the extent not inconsistent herewith or restricted <br />hereby, and to the extent not inconsistent with nor restricted by federal, state or local law, the <br />Board may authorize any officer.or officers, agent or agents, to enter into any contract or <br />execute and deliver any instrument in the name of or on behalf of the Consortium, and such <br />authority may be general or confined to specific instances. <br />(f) The Board Shall: <br />(1) Conduct its business and affairs for the benefit of the Consortium members. <br />(2) Provide policy direction and oversight to the South Bend Department of <br />Community and Economic Development, in its exercise of its obligations here <br />under. <br />(3) Review and approve all applications made to HUD for funding for other <br />housing programs funded under NAHA to be implemented within the <br />Consortium. <br />(4) Enter into, make and perform contracts of every kind with members of the <br />Consortium, and the various instrumentalities, agencies or departments thereof, <br />the United States of America, the State of Indiana, or any political subdivision or <br />agency or instrumentality thereof, or with any unit, private corporation, <br />partnership, association or foundation public and private, in order to implement <br />and further the purposes of this <br />Agreement. <br />(5) Accept grants and gifts from the Consortium members, the United States of <br />America, the State of Indiana, other units of general local government, and from <br />any unit, private corporation, partnership, association or individual: Provided, <br />however, that no gift or grant may be accepted from any individual receiving <br />services or from any member of the professional or clerical staff of the South <br />Bend Department of Community and Economic Development; Provided, further, <br />that any grant or gift received by the Board sha11 be transferred to the Division <br />of Community Development of the South Bend Department of Community and <br />Economic Development, for deposit in the St. Joseph Housing Consortium <br />Checking Account. <br />(6) In general, exercise all powers which now or hereafter may be conferred by <br />law upon the Consortium for purposes of carrying out the purposes of this <br />Agreement. <br />7. Fiscal Responsibilities <br />Financial and fiscal authority and responsibility for all funds received and administered <br />in connection with this Agreement, shall, on a day-to-day basis, be vested in the Division of <br />5 <br />
