ORDINANCE NO. <br />AN ORDINANCE AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED AT <br />3423 AND 3507 SOUTH MICHIGAN STREET, SOUTH BEND, INDIANA, WITH <br />CONTIGUOUS VACANT LAND, COUNCILMANIC DISTRICT SIX IN THE CITY OF SOUTH <br />BEND, INDIANA <br />STATEMENT OF PURPOSE AND INTENT <br />The petitioner is requesting a zone change from MU Mixed Use District to SF2 Single Family and <br />Two Family District to allow the renovation of an existing 44,500 square foot building for a new <br />primary and secondary public charter school. <br />NOW THEREFORE BE IT ORDAINED by the Common Council of the City of South Bend, <br />Indiana as follows: <br />SECTION 1. Ordinance No. 9495-04, is amended, which ordinance is commonly known as the Zoning <br />Ordinance of the City of South Bend, Indiana, be and the same hereby is amended in order that the zoning <br />classification of the following described real estate in the City of South Bend, St. Joseph County, State of <br />Indiana, as per the deed recorded on February 5, 2002, as Document No. 0200811.1 in the St. Joseph <br />County Recorder's •Office: <br />Parcel I: A parcel of land being a part of the Southwest Quarter of the Southwest Quarter of Section <br />24, Township 37 North, Range 2 East and being more particularly described as follows: <br />Commencing at the Southeast corner of Lot 7 as the same is shown and designated on the plat of <br />John E. Walz's Revised Addition as recorded in the Office of the Recorder of St. Joseph County, <br />Indiana; thence Northeasterly along the Westerly Right-of--Way line of Michigan Street, a 100 foot <br />Right-of--Way, a distance of 130.00 feet more or less to a point on said line that is 1.34 feet South of, <br />by rectilinear measurement, the North line of Lot 9 in said addition, said point being the place of <br />beginning for this description; thence West, parallel with and 1.34 feet South of said North line, a <br />distance of 165 feet more or less to the Westerly line of said Lot 9; thence Southwesterly along said <br />Westerly line, a distance of 15.00 feet; thence West parallel with said North line of Lot 9; a distance <br />of 7 feet more or less to the centerline of a vacated 14 foot alley; thence Southwesterly along said <br />centerline, a distance of 115.66 feet to the point of intersection of centerline with the North Right-of- <br />Way line of Sherwood Avenue; thence West along said North Right-of--Way line, a distance of 172 feet <br />more or less to said North Right-of--Way lines, intersection with the Easterly Right-of--Way line of Main <br />Street; thence Northeasterly along said Easterly Right-of--Way line, a distance of 486.91 feet more or less <br />to a 3/4 inch iron pipe found marking the intersection of said Easterly Right-of--Way line with the South <br />Right-of--Way line of Dean Street; thence East, along said South Right-of--Way line a distance of 172 <br />feet more or less to a 3/4 inch iron pipe found marking the intersection of said South Right-of--Way <br />line with the centerline of said vacated 14 foot alley; thence Southwesterly along said centerline, a <br />distance of 128.24 feet more or less to a point; thence Southeasterly a distance of 7 feet more or less <br />to a point on the West line of Lot 12 in said Walz's Revised Addition that is 3 feet South of the <br />Northwest corner of said lot; thence Southeasterly 81.90 feet to a point 10 feet South of and 82.42 <br />feet East of the Northwest corner of said Lot and 10 feet South of and 82.5 feet West of the Northeast <br />corner of said Lot; thence continuing Southeasterly 82.08 feet to a point on the East line of said Lot 12 <br />marked by a 3/4 inch iron pipe that is 17 feet South on the Northeast corner thereof; thence <br />Southwesterly along said Westerly Right-of--Way line of Michigan Street, a distance of 345.16 feet <br />more or less to the place of beginning. <br />BDDB01 5591517v1 <br />
