ORDINANCE NO. ~~ J I ~~ <br />AN ORDINANCE AMENDING ARTICLE 6.5 <br />OF CHAPTER 21 OF THE SOUTH BEND MUNICIPAL CODE <br />PROVIDING FOR CITY ADOPTION OF COUNTY LANDMARKS <br />UPON CITY ANNEXATION OF AFFECTED LAND <br />STATEMENT OF PURPOSE AND INTENT <br />The County of St. Joseph is the site of several historic landmarks designated as such by the <br />Historic Preservation Commission of St. Joseph County in tandem with the St. Joseph County <br />Council, and the procedure for designating landmarks lying in St. Joseph County outside the City of <br />South Bend's territorial limits is substantially the same as for designating landmarks within the City <br />of South Bend. Because the City of South Bend has been annexing to its boundaries realty which <br />previously lay within St. Joseph County, it is in the best interest of the citizens of South Bend that <br />landmarks previously designated within the County be accorded landmark status in the City of South <br />Bend upon annexation. This Ordinance will accomplish that objective and assure continuity of historic <br />landmark designations between the City and County. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY <br />OF SOUTH BEND, INDIANA, AS FOLLOWS: <br />SECTION I. Chapter 21, Article 6.5, of the South Bend Municipal Code shall be amended <br />to add a new Section 21-117.3 entitled Annexed Landmarks to read as follows: <br />Section 21-117.3. Annexed Landmarks. <br />where the Historic Preservation Commission has designated a historic landmark in Saint <br />Joseph County. and the real estate on which the landmark i situated or comprised ie subsequently <br />annexed to and brought within the boundaries of the City of South Bend. such Landmark shall upon <br />annexation to the City of South Bend. become a historic landmark of the City of South Bend subject <br />to regulation under this Section. The Historic Preservation ommission shall notify the owner of <br />such real estate in writing by certified mail of the City of South Bend's landmark designation. <br />SECTION II.
