REGULAR MEETING APRIL 13, 2009 Skylar Diggins thanked the Council for the honor of this Resolution. She stated that she could not have done all this without the help of her teammates. She stated that she is so proud of them. Skylar noted that she looks forward to playing for the Fighting Irish at Notre Dame and hopes to see everyone there. Additionally, Councilmember’s Dieter, Puzzello, White, Kirsits, Oliver Davis; Rouse offered their comments and congratulated Skylar on her wonderful accomplishments and wished her good luck at Notre Dame. Councilmember Rouse made a motion to adopt this Resolution by acclamation. Councilmember White seconded the motion which carried. RESOLVE INTO THE COMMITTEE OF THE WHOLE At 7:30 p.m. Councilmember Varner made a motion to resolve into the Committee of the Whole. Councilmember LaFountain seconded the motion which carried by a voice vote of nine (9) ayes. Councilmember Puzzello, Chairperson, presiding. Councilmember Puzzello explained the procedures to be followed for tonight’s meeting in accordance with Article 1, Section 2-11 of the South Bend Municipal Code. Councilmember Puzzello stated that a brochure may be found on the railing in the Council Chambers explaining those procedures. PUBLIC HEARINGS BILL NO. 01-09 PUBLIC HEARING ON A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED AT 2013 FORD ST., SOUTH BEND, IN 46619, COUNCILMANIC DISTRICT 6 IN THE CITY OF SOUTH BEND, INDIANA Councilmember Kirsits made a motion to hear the substitute version of this bill. Councilmember Varner seconded the motion which carried by a voice vote of nine (9) ayes. Councilmember Kirsits, Chairperson, Zoning and Annexation Committee, reported that this committee held a meeting this afternoon and it was the consensus of the committee to send this substitute bill to the full Council with a favorable recommendation. th Ms. Christa Nayder, Staff Planner, Area Plan Commission, 11 Floor County-City Building, 227 W. Jefferson Blvd., South Bend, Indiana, presented the report from the Commission. Ms. Nayder advised that the petitioner is requesting a zone change from SF2 Single Family and Two Family District to MU Mixed Use District to allow a convenience store. On site is a commercial building on the same lot as a home and detached garage. To the north are single family homes zoned SF2 Single Family and Two Family District. To the east is a vacant lot and single family homes zoned SF2 Single Family and Two Family District. To the south are single family homes and a parking lot zoned SF2 Single Family and Two Family District. Directly to the west is the single family home and garage on the same lot. To the west across Warren Street is the West Side Democratic Club zoned MU Mixed Use District. The area to be rezoned is 1,559 square feet. There is one existing 836 square foot building which takes p 53.6% of the site. The two parking spaces provided consist of 475 square feet or 30.5% of the site. There is 248 square feet or 15.9% open space. The access is from Ford Street. Prior to adoption of the current zoning ordinance and map, this property was zoned C Commercial. Ms. Nayder noted that the City’s Community Development Department has expressed some concerns about the proposed rezoning, notice the City Plan calls for this area to be medium density 5
