RANJAN J. AMIN WHEREAS, the Common Council of the City of South Bend, Indiana, has adopted a Declaratory Resolution designating certain areas within the City as Economic Revitalization Areas for the purpose of tax abatement consideration; and WHEREAS, a Declaratory Resolution designated the area commonly known as 60971 U.S. 31 South, South Bend, Indiana, and which is more particularly described as follows: A parcel of land being a part of the Southeast Quarter (1/4) of Section Thirty-Five (35), and a part of the Southwest Quarter (1/4) of Section Thirty-Six (36), all in Township Thirty-Seven (37) North, Range Two (2) East, Centre Township, St. Joseph County, Indiana and being more particularly described as follows: Beginning at a point on the east line of said Southeast Quarter, a distance of 406.54 feet North 0 degrees 00 minutes 00 seconds East of the Southeast corner of said Southeast Quarter; thence South 13 degrees 35 minutes 03 seconds East, along the westerly right-of--way of Main Street, a distance of 153.90 feet to its intersection with the westerly right-of--way line of U.S. Highway #31; thence South 17 degrees 09 minutes 11 seconds West, along said U.S. #31 right-of--way line, a distance of 133.80 feet to an iron stake found in place; thence North 89 degrees 19 minutes 49 seconds West, parallel with the south line of said Southeast Quarter, a distance of 501.70 feet to an iron stake found in place and being on a point of the east line of a tract of land conveyed to Raymond K. Snyder and Anna J. Snyder in Deed Record 315, page 175; thence North 0 degrees 27 minutes 06 seconds West, a distance of 274.67 feet to an iron stake found in place; thence South 89 degrees 39 minutes OS seconds East, a distance of 507.23 feet to the place of beginning. Commonly known as 60971 U.S. 31 South, South Bend, Indiana; and which has Key Number 01-1017-0368, as an Economic Revitalization Area; and WHEREAS, notice of the adoption of a Declaratory Resolution and the public hearing before the Council has been published pursuant to Indiana Code 6-1.1-12.1-2.5; and WHEREAS, the Council held a public hearing for the purposes of hearing all remonstrances and objections from interested persons; and WHEREAS, the Council has determined that the qualifications for an economic revitalization area have been met. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend, Indiana, as follows: SECTION I. The Common Council hereby confirms its Declaratory Resolution designating the area described herein as an Economic Revitalization Area for the purposes of tax abatement. Such designation is for Real property tax abatement only and is limited to two (2) calendar years from the date of adoption of the Declaratory Resolution by the Common Council. SECTION II. The Common Council hereby determines that the property owner is qualified for and is granted Real property tax deduction for a period of (3) three years, and further determines that the petition, the Memorandum of Agreement between the Petitioner and the City of South Bend, and the Statement of Benefits comply with Chapter 2, Article 6, of the Municipal Code of the City of South Bend and Indiana Code 6-1.1-12 et se . AMIN (CHOICE SUITES) Dear Council Member Dieter: Please find attached the Department of Community & Economic Development's report on a commercial real property tax abatement petition for the above-referenced petitioner for construction of a new facility located at 60971 U.S. 31 South. Also attached is a copy of the petition, Statement of Benefits form, and supporting information. The report contains the Department's findings relative to the above petition. The petitioner, Ranjan J. Amin proposes to tear down the existing Drake Motel and replace it with a new three-story, 71- room Choice Suites hotel. The petitioner is asking for a special exception because the project does not meet the general standards for real property tax abatement as set forth in the City's code. Ranj an J. AMIN (CHOICE SUITES) DATE: APRIL 30, 2007 On February 19, 2007, a petition for real property tax abatement consideration for property located at 60971 U.S. 31 South was filed with the City Clerk by Ranj an J. Amin. The applicant is asking for a special exception because the project does not meet the general standards for real property tax abatement set forth in Chapter 2, Article 6, Section 2-77 through 2-83.3 of the Municipal Code of the City of South Bend. Pursuant to Chapter 2, Article 6, Section 2-82 of the Municipal Code of the City of South Bend, this petition was referred to the Department of Community and Economic Development for purposes of investigation and preparation of a report determining whether the area qualifies as an Economic Revitalization Area pursuant to I.C.6-1.1-12.1 and whether all zoning requirements have been met. The Department of Community and Economic Development has reviewed the petition, investigated the area, and makes the following report. PROJECT SUMMARY Ranjan J. Amin proposes to tear down and replace the existing Drake Motel with athree-story, 71- room Choice Suites hotel. The total cost of the project is estimated at $3,094,000. The new hotel will be constructed with modern conveniences such as a conference room, swimming pool, and exercise room. The estimated square footage of the project is 43,368. Total taxes to be abated during the (3) three-year abatement period are estimated at $210,313. Total taxes to be paid during the (3) three-year abatement period are estimated at $106,742. EMPLOYMENT IMPACT Per the petition, it is estimated that the total project will create (11) eleven new, permanent, full-time jobs and (4) four new, permanent, part-time jobs within the first year representing a new annual payroll of $200,000. ABATEMENT QUALIFICATION 1. A review of the tax abatements previously granted finds that the petitioner has not been granted or associated with any previous tax abatements: 2.
