Inks and vas adopted by the Eoard of Public Workse SCL,LTTION NC. i2-2009 the following P~esolutio~~ ®F A ASTER AGENCY AG EI~/IENT DY AND BETWEEN TIDE S®L1TIi FEND INDIANA ®AIZD ®F PLTI,IC_® S L,ATINCT T® 2009 PIt().IF~'T'S WIIE AS, the South Eend Department of Redevelopment, acting by and through i~;s Redevelopment Commission the "Co mission"~ has an interest in various properties located irIl the City of South Eend, Indiana the "Properties"); and WpIE AS, as part of its redevelopment projects during the calendar year of 2009, the Co ission intends to pursue projects that are located on or physically co acted to the Properties including ne~v construction and re-construction of streets and other infrastructure improvements located on or physically connected to the Properties (the "Projects"); and WIdE AS, the South Fend Board of Public Works ("DPW"~ has the expertise and staff to enter into contracts and manage coast coon of the Projects9 and WI-IEI~EAS, the 13PW and the Co ission desire to enter into a I1~Iaster Agency Agreement wherein the EPW shall act as the Con2mission's agent with respect to the Projects and other related matters, a copy said Faster Agency Agreement is attached hereto and incorporated herein as xhibi~ "A9' l~ , °T ~ ~1~ by the City of South Bend, Indiana, Board of Public Works as follows; Section 1.
