SUBSTITUTE <br />ORDINANCE NO. l ~ s () ~ ~ 1 <br />AN ORDINANCE OF THE COMMON COUNCIL <br />OF THE CITY OF SOUTH BEND, INDIANA, <br />AMENDING ORDINANCE N0.8007-89 AS TO THE MONTHLY <br />SERVICE CHARGE FOR LEAF COLLECTION AND REMOVAL <br />STATEMENT OF PURPOSE AND INTENT <br />On August 14, 1989, the South Bend Common Council established aNon-Reverting Leaf <br />Removal Services Operational Fund for the acquisition of equipment for the collection of leaves; <br />for the maintenance, operation, upkeep and depreciation of and repair to such equipment; for <br />wages,, salaries, and benefits of personnel operating such equipment and performing services <br />related to the removal of leaves throughout the City of South Bend, Indiana. This Fund was <br />established in Ordinance No. 8007-89. Since this fund was established over ten years ago, the <br />costs of operating the Re-Leaf Program have increased and some of the equipment is in need of <br />replacement. However, the monthly amount set aside for the operation of this program has not <br />increased since 1989. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE <br />CITY OF SOUTH BEND, INDIANA, THAT ORDINANCE NO. 8007-89 BE AMENDED AS <br />FOLLOWS: <br />SECTION I. ANon-Reverting Leaf Removal Services Operational Fund is established to <br />be used for the acquisition of equipment for the collection of leaves; for the maintenance, <br />operation, upkeep and depreciation of and repair to such equipment; for wages, salaries and <br />benefits of personnel operating such equipment and otherwise performing services related to the <br />removal of leaves throughout the City of South Bend, Indiana and other manpower-related <br />expenses; for equipment replacement and upkeep to the extent not provided for through <br />depreciation; and for the payment of interest charges on debts and other obligations. <br />provided. Voluntary donations and/or grant monies received by the City from public <br />or private entities may be deposited into the Fund to be used for those purposes as provided for <br />herein. <br />~' <br />
