Box 540 <br />South Bend, IN 46624 <br />574 237 6000 Tel <br />574 237 6001 Fax <br />www.cbre.com/southbend <br />Re: Gateway Plaza Real Estate, LLC (the "Petitioner") Application for Real <br />Property Tax Abatement <br />Dear Ladies and Gentlemen: <br />On behalf of the above referenced Petitioner, we are requesting, pursuant to Section 2-84 <br />of she South Bend Municipal Code, a Special Exception to the Real Property Tax <br />Abatement definition for Warehouse Development contained within the South Bend <br />Municipal Code. 'The definition for Warehouse Development refers to: "economic <br />activities described in major groups 421, 422, and 493 of the North American Industry <br />Classification-United States, 2002 manual published by the United States Office of <br />Management and Budget's Economic Classification Policy Committee, which manual is <br />hereby incorporated by reference..." However, in the 2002 version of the manual the <br />economic activities described in groups 421 and 422 were moved to other groups. Due to <br />scrivener's errors the group numbers were not revised when reference to the 2002 version <br />of the manual was incorporated into the Municipal Code. Group 493 is very limited in <br />scope and dots not include the type of activities to be carried out in the building as <br />proposed by the F~etitiotter. Groups 4'21 and 422 include many of those activities. <br />Further, those activities have been included in groups 423, 424, and 425 of the 2002 <br />manual. <br />In view of the above explanation, and the considerable amount of additional investment <br />proposed in the City, the Petitioner is requesting a Special Exception for the Project. <br />Thank you very much for your consideration of this request.
