RESOLUTION NO. 3~(~ I " ~5 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, APPROVING ACQUISITION OF AND DESIGNATING THE BOARD OF PUBLIC WORKS TO PURCHASE PROPERTY NEEDED FOR CONSTRUCTION OF THE AUTEN ROAD CONNECTOR WHEREAS, the Common Council of the City of South Bend, Indiana, has determined by separate Ordinance (Bill 11-09) that a true and real need exists for the acquisition of certain properties located in the Auten Road corridor to be used for the construction of the Auten Road Connector; and WHEREAS, Holliday Properties is the owner of a parcel of land located at 51270 Mayflower Road, South Bend, Indiana, (the "Property") which is in the Auten Road corridor; and WHEREAS, Holliday Properties has agreed to sell the Property for a price not to exceed Three Hundred Thousand Dollars ($300,000.00) which is within the Council's approved appropriation of Major Moves Funds for this purpose (Common Council Bill 11-09); and WHEREAS, the Common Council of the City of South Bend, Indiana, believes that the acquisition of the Property is in the best interests of the City of South Bend and its residents; and WHEREAS, the Common Council of the City of South Bend, Indiana, has determined that the Board of Public Works of the City of South Bend, Indiana is the appropriate entity to purchase the property. NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, A5 FOLLOWS: Section I. Acquisition of property located at 51270 Mayflower Road, South Bend, Indiana, is in the best interests of the City of South Bend, Indiana, and the South Bend Common Council authorizes the South Bend Board of Public Works to take the steps necessary to purchase this property for a price not to exceed Three Hundred Thousand Dollars ($300,000.00). Section II. The Common Council hereby designates and confirms the following persons to execute and accept, and to witness the execution and acceptance, respectively, those documents necessary to the consummation of the transaction contemplated by this Resolution.
