EXECUTIONCOPY <br />Bend,, which contribution shall be, paid over a period of five (5) years at <br />$445,000.00 per year, with the ,first payment duo twelve (12) months after the <br />Resort commences gaming operations,. The City shall use, the entirety of the <br />contributions made bythe Band Parties under this subsection (a) exclusively <br />for the express purposes stated herein. The City shall provide the Band parties <br />with an annual report demonstrating the City's full compliance with its <br />obligations under this subsection, <br />(b). Memorial Children',Y Hospital. The Band Parties shall contribute $500,000.00 <br />to Memorial Children"s Hospital of South Bend for the renovation and <br />modernization of the Newborn Intensive Care Unit, (NICU), which <br />contribution shall be paid over a period iod of five (5) <br />years at $100,000.00 per <br />year with the first payment due twelve, (12) months after the Resort <br />commences gaming operations. <br />(c). Bowman Creek-Project, The Band Parties shall contribute $500,000.00 to the <br />Bowman Creel-, Project for initiatives intended to restore and protect the Creek <br />and educate the public regarding its importance to the region, which <br />contribution shall he paid over a period of five (5) years at $100,000.00 per <br />year with the first payment due twelve (12) months after the Resort <br />commences gaming operations. The use and purpose of each annual donation <br />shall be determined by the Band Parties in -consultation with the Bowman <br />Creek Project representatives designated by the City. <br />(d). South Bend Community Schools. The Band Parties shall donate $500,000.00 <br />to the South Bend Community School Corporation, which donation shall be <br />paid over a period of five (5) years at $100,000.00 per year with the first <br />payment due twelve (12) months after the Resort commences gaming <br />operations. The use and purpose of each annual donation shall be determined <br />by the Band Patties in consultation with the Superintendent of the South Bend <br />Community -School Corporation. <br />(e). Prairie Avenue. Resurfacing. The Band Parties shall cover all costs to <br />resurface Prairie Avenue from US-31 to Locust Road, which costs, shall not <br />exceed $500,000.00 and shall be payable in accordance with the payment <br />requirements of a contract between INDOT and the contractor engaged to <br />perform the work. <br />(f). Prairie Avenue Landscaping. The Band Parties shall cover all costs to <br />enhance the landscape of Prairie Avenue within the public right-of-way from <br />US-31 to Locust Road, which costs shall not exceed $200,000.00 and shall be <br />payable in accordance with the payment requirements of a contract between <br />INDOT and the contractor engaged to perform the work. <br />Pago 12 of 22 <br />
