Magliozzi <br />Assistant Director <br />Phone 574 235-9571 www.stjosephcountyindiana.com/areaplan Fax 574 235-9813 <br />January 21, 2009 <br />The Honorable Council of the City of South Bend <br />4th Floor, County-City Building <br />South Bend, IN 46601 <br />RE: A proposed ordinance of John & Leona Rappelli and Rosemary Mandrici to zone from SF1 Single <br />Family and Two Family District & MF1 Urban Corridor Multi Family District to MU Mixed Use <br />District, property located at southeasterly corner of Ivy Court and Twyckenham Drive, City of South <br />Bend - APC# 2494-08 <br />Dear Council Members: <br />I hereby Certify that the above referenced ordinance of John & Leona Rappelli was legally advertised on <br />Thursday, January 8, 2009 and that the Area Plan Commission at its public hearing on Tuesday, January <br />20, 2009 took the following action: <br />Upon a motion by John McNamara, being seconded by Dan Brewer and unanimously can: ied, <br />the proposed ordinance of John & Leona Rappelli and Rosemary Mandrici to zone from SF 1 <br />Single Family and Two Family District & MF 1 Urban Corridor Multi Family District to MU <br />Mixed Use District, property located at southeasterly corner of Ivy Court and Twyckenham <br />Drive, City of South Bend is sent to the Common Council with a favorable recommendation, <br />subject to the following written commitments: 1) access easements to Jameson House on - <br />parce1024-1008-0615; 2) relocation of the dumpster so that it does not obstruct the view from <br />the Jameson House building on parcel 024-1005-0615; and 3) no controlled uses or liquor <br />stores as defined in the South Bend Zoning Ordinance. A mixed use development containing <br />both residential and commercial components would not be out of character in this <br />neighborhood. The proximity to the University of Notre Dame, high density residential <br />projects in the area, the commercial at Edison and South Bend Avenue and the new <br />Innovation Park building are driving the need for a walkable, commercial-style development. <br />PLEASE NOTE that the Ordinance has been amended by the petitioner and is different than that used for <br />the Common Council's first reading. The amended Ordinance was legally advertised and heard by the Area <br />Plan Commission. <br />The deliberations of the Area Plan Commission and points considered in arriving at the above decision are <br />shown in the minutes of the public hearing, and will be forwarded to you at a later date to be made a part of <br />this report. <br />Sincerely, <br />n W.
