Martin, Clerk <br />ADOPT RESOLUTION NO. 06-2016 — A RESOLUTION OF THE CITY OF SOUTH BEND, <br />INDIANA BOARD OF PUBLIC WORKS ACCEPTING THE TRANSFER OF REAL <br />PROPERTY FROM THE CITY OF SOUTH BEND BOARD OF PARKS COMMISSIONERS — <br />—BAR'1'LETI STREET RIGHT-OF-WAY PROPERTY <br />Upon a motion made by Mr. Relos, seconded by Ms. Maradik and carried, the folloN ing <br />Resolution was adopted by the Board. of Public Works. <br />RESOLUTION NO. 06-2016 <br />A RESOLUTION OF CITY OF SOUTH BEND, INDIANA BOARD OF PUBLIC WORKS <br />ACCEPTING THE TRANSFER OF REAL, PROPERTY FROM THE CITY OF SOUTH <br />BEND BOARD OF PARKS COMMISSIONERS <br />WHEREAS, the South Bend Board of Public Works (the `Public Works', the <br />contracting body of the City of South Bend, Indiana (the "City"), which exists and operates <br />under the provisions of I.C. 36-9-6 (the "Act"), serves as the holder of certain real property <br />situated in the City of South Bend, Indiana; and <br />WHEREAS, the City of South Bend, Indiana, Parks and Recreation. Department, by and <br />through its Board of Park Commissioners (the "Board'), holds certain real property situated in <br />the City of South Bend, Indiana; and <br />WHEREAS, pursuant to I.C. 36-1-11-8, Public Works and the Board may transfer or <br />exchange property with one another upon terms and conditions agreed upon by the entities as <br />evidenced by the adoption of substantially identical resolutions of each entity; and <br />WHEREAS, the City, acting by and through the Board, agrees to the transfer of real <br />estate depicted and attached hereto as Exhibit A from the Board; and <br />WHEREAS, Public Works desires to authorize the staff of the City to cause the <br />preparation of the necessary quit claim deed effecting this transfer, and to accept and present for <br />recording said quit claim deed, upon execution; and <br />WHEREAS, the Board is expected to adopt a corresponding resolution consistent with <br />I.C. 36-1-11-8. <br />NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND BOARD OF <br />PUBLIC WORKS AS FOLLOWS: <br />The following transfer of real property situated in St. ,Joseph County, Indiana, <br />shall be, and hereby is, authorized and approved: <br />a. Public Works shall accept the transfer of the Board's interest in the real <br />estate as more particularly described in Exhibit A by quit claim deed; and <br />2. The staff of the City shall be, and hereby are, authorized to cause the preparation., <br />acceptance, and recordation with the St. Joseph County Recorder's Office of the quit claim deed -- <br />necessary to effect the transfer stated above. <br />3. This Resolution shall be in full force and effect upon its adoption. <br />ADOPTED at a meeting of the City of South Bend Board of Public Works held on <br />January 26, 2016, on the 13°i Floor of 229 W.
