ORDINANCE NO. ~ ~~ t -~ <br />AN ORDINANCE AMENDING THE ZONING ORDINANCE <br />FOR PROPERTY LOCATED AT <br />541 WILLIAM AND 543 WILLIAM, <br />COUNCILMANIC DISTRICT No. 1 <br />IN THE CITY OF SOUTH BEND, INDIANA <br />STATEMENT OF PURPOSE AND INTENT <br />WHEREAS, the subject properties are two units, each of approximately 1,700 square <br />feet, in a single two-story (with attic) frame building which former owners have used as a <br />multifamily rental property and which the current owner, F.1.R.E., Inc. d/b/a families First <br />Ceneter, intends to rehabilitate and use, in the northern unit (543 William), for offices to conduct <br />supervised visitation services and , in the southern unit (541 William), for residential rental <br />purposes. <br />WHEREAS, the subject properties are currently zoned MF1 Urban Corridor Multifamily <br />District and have been used for that purpose and the current owner of the properties intends to <br />change their use to uses consistent with the zoning classification OB Office Buffer District. <br />BE IT ORDAINED by the Common Council of the City of South Bend, Indiana as <br />follows: <br />SECTION 1. Ordinance No. 9495-04, is amended, which ordinance is commonly <br />known as the Zoning Ordinance of the City of South Bend, Indiana, be and the same hereby is <br />amended in order that the zoning classification of the following described real estate in the City <br />of South Bend, St. Joseph County, State of Indiana: <br />Lot Numbered Six (6) as shown on the recorded Plat of Fred W. Keller's <br />Subdivision of Lots No. 16, 17, 18 and 32 of Burroughs' Subdivision of Bank Out <br />Lots Numbered 115 of the Third Plat of Out Lots of the Town, now City of South <br />Bend, platted by the State Bank of Indiana, EXCEPTING THEREFROM a lot or <br />parcel of land 40 feet in width, East and West, taken off of and from the entire <br />width of the West end thereof. <br />A part of Lots Five (5) and Six (6) as shown on the recorded Plat of Fred W. <br />Keller's Subdivision of Lots Sixteen (16), Seventeen (17), Eighteen (18), and <br />Thirty-two (32) of Burrough's Subdivision of Bank Out Lot of One Hundred <br />Fifteen (115) of the Third Plat of Out Lots of the Town, now City of South Bend, <br />in St. Joseph County, Indiana, and the vacated alley on the North Side of Lots 16, <br />17, 18 which part is bounded by a line running- as follows: Beginning at the <br />Southwest comer of said Lot 6; thence East Forty (40) feet; thence North to a <br />point Ten (10) feet South of the North line of Lot 5 in said subdivision; thence <br />Southwesterly parallel with the Northerly line of said Lot 5 to the West line of <br />said Lot 5; thence South along the West boundary of said Lots 5 and 6 to the <br />place of beginning. <br />be and the same is hereby established as OB Office Buffer District. <br />
