NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend, Indiana, as follows: SECTION I. The Common Council hereby confirms its Declaratory Resolution designating the area described herein as an Economic Revitalization Area for the purposes of tax abatement. Such designation is for Real property tax abatement only and is limited to two (2) calendar years from the date of adoption of the Declaratory Resolution by the Common Council. SECTION II. The Common Council hereby determines that the property owner is qualified for and is granted Real property tax deduction for a period of (6) six years, and further determines that the petition, the Memorandum of Agreement between the Petitioner and the City of South Bend, and the Statement of Benefits comply with Chapter 2, Article 6, of the Municipal Code of the City of South Bend and Indiana Code 6-1.1-12 et sea. Subject: Substitute Confirming Resolution - Odyssian Technology Date: April 1, 2007 A substitute resolution is necessary for the commercial real estate tax abatement submitted to the Common Council on January 8, 2007, for Odyssian Technology. Odyssian has submitted a revised commercial real estate petition with information that increases the length of the tax abatement period the firm is qualified for from four to six years. In addition, the firm submitted a revised personal property petition which reduced the estimated cost of the equipment from $384,816 to $147,800. The revised real estate abatement petition came about as a result of firming up contractors and subcontractors for the planned renovation work and improved knowledge of the contractors' employment practices. The reduction in personal property resulted from a change in the ownership pattern for equipment to be supplied by the federal government. A copy of the revised real estate petition together with the tax abatement schedule and the public bonus point summary for the commercial real estate abatement are attached. The substitute resolution contains the revised tax abatement period. While the resolution for personal property does not need to be changed, the revised petition for personal property along with a copy of the revised tax abatement projections for the personal property is attached for the Common Council's information and for the record. Because of the changes described above a representative from Odyssian Technology will be available to meet with Community and Economic Development (CED) Committee on Monday, April 9, 2007. Assuming the Committee approves the changes, the confirming resolutions for both the real estate and the personal property tax abatements will be considered at the public meeting Monday evening. Describe the proposed redevelopment or rehabilitation project, including information about physical improvements to be made, the proposed use of the improvements, and a general statement as to the importance of the project to your business: i. We are purchasing 2 buildings in the CBD of Downtown South Bend's East Race Village area, 511 E Colfax and 210 Niles. We plan on renovation the 2800 sft Colfax building by making a new entry, adding windows, redesigning the office space, adding a kitchen break room, conference room, engineering center and restrooms that are handicap accessible. We plan on reworking the facade by adding windows and new doors, lightning, landscaping and paving parking areas. We plan on redeveloping the adjoining empty lot into a courtyard with a wrought iron gate and a few parking spots. We plan on adding security and perimeter lighting. This facility will be set up with state of the art IT capabilities and we hope to give the look of a High Tech Research environment. The adjoining 2588 sft facility, having a separate address of 210 Niles Ave., wilt be renovated by replacing windows and doors, power washing and painting, replacing the roof, surfacing floors, adding security and lighting, renovating the bathroom, and adding utilities as needed to support a research & development laboratory. Describe the overall nature of the business and of the operations occurring at the Property (attach additional sheet if more space is needed): Odyssian Technology began operations in February 2003 as a result of an Indiana 21'` Century Research and Technology Fund grant. Odyssian Technology is a high technology company focused on technoloQV innovation and creative product development related to advanced lightweight composites, multifunctional structure, smart structure, and integrated systems. Odyssian is involved in developing technology and products for both the military and consumer market place. Exciting work is underway in the development of: hand launched aircraft with structurally integrated systems (Rev 8111 /03) for use in surveillance, communications support, and aerial mapping; advanced liguidJgas containment systems with integrated leak detection sensors for use in preventing the leakage of toxic and environmentally damaging chemicals; thin film igniters for use in improving the reliability of missile batteries, parachute deployment, and airbag safety systems; and various other products involving the integration ofelectronic/electrical systems into structure, housing, and devices. Odyssian Technology has leveraged its Indiana 21st Century grant to win several federally funded Small Business Innovation Research (SBIR) programs. Often Odyssian Technology teams with Indiana based universities, businesses, agencies, and consultants during the pursuit and performance of our technology development programs. Odyssian has worked with the University of Notre Dame, Purdue University, Rose-Hinman Institute of Technology, Crane Navel Surface Warfare Center, Diversified Systems of Indianapolis, as well as, multiple consulting professionals and professors from within Indiana. In addition, we have worked with government and business organizations outside of Indiana including, The Boeing Company, EaglePicher, Space Vehicle Directorate of the Air Force Research Laboratory (AFRL), Propulsion Directorate of the AFRL, Aeronautical Systems Command, and Air Vehicle Directorate of the AFRL. 3.
