ORDINANCE NO. 10 414-10 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AMENDING OF CHAPTER 6, ARTICLE 4, SECTION 6 -10 (d)(2) OF THE SOUTH BENDMUNICIPAL CODEADDRESSING PLUMBING EXCAVATOR FEES CHARGED BY THE BUILDING DEPARTMENT STATEMENT OF PURPOSE AND INTENT Recently, on October 26, 2015, the South Bend Common Council enacted Ordinance No. 10394 -15 (Bill No. 67 -15) which adjusted various permit and contractor registration fees charged by the consolidated Building Department of the City of South Bend and St. Joseph County. This was done to assure that revenue from fees and services collected by the Building Department is adequate for effective operation. It has been brought to the Council's attention that fees for registration of excavators, as defined in the South Bend Municipal Code, Chapter 6, Article 4, Section 6- 10(d)(1)b, were not increased to $125.00, unlike the fees for other contractors, and that this omission was unintentional. Adjustment of the excavator registration fees from one hundred dollars ($100.00) to one hundred twenty -five dollars ($125.00) is necessary to correct this oversight and assure that all contractors are treated equally. Adjustment of the fees as provided in this ordinance is in the best fiscal interest of the City of South Bend. NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of South Bend, Indiana, as follows: Section I. Chapter 6, Article 4, Section 6 -10 (d)(2) b of the South Bend Municipal Code shall be amended to read as follows: (d) Registration and permit for plumbing services. (2) Registration required: a. All persons performing plumbing services within the City shall be a Plumbing contractor and shall register with the Department; provided, however, that the owner - occupant of a dwelling shall not be required to register when he or she is installing altering or repairing the plumbing of that dwelling. b. Registration shall be on forms provided by the Department and shall be accompanied by payment of a registration fee, as follows: Plumbing contractors ..... $125.00 Excavators (as defined in Ssection 6- 10(d)(1)b�...... 490.09 125.00 Sewer cleaners.... 125.00
