`~ Public Works and Property Vacation Committee <br />2009 South Bend Common Council <br />The January 26, 2009 meeting of the Public Works and Property Vacation Committee of the South Bend <br />Common Council was called to order by its Chairperson, Council Member David Varner at 3:30 p.m. in <br />the Council's Informal Meeting Room. <br />Persons in attendance included Council Members Rouse, Henry Davis, Jr., Varner, White, Dieter, <br />LaFountain, and Puzzello, Public Works Director Gary Gilot, City Engineer Carl Littrell, ,Michael <br />Danch, Bill Schalliol, Martha Lewis, Mrs. Kopola, IU South Bend Intern Jeremy Toschlog, Jamie Loo of <br />the South Bend Tribune and Kathleen Cekanski-Farrand, Council Attorney. <br />Dr. Varner noted that the Committee members include Council Members Henry Davis, Jr., Tom <br />LaFountain, Timothy Rouse and himself. <br />Bill No. 03-09 Request to Vacate an Alley & Portion of a Street ROW Involving Main Street, <br />Western Avenue, Michigan Street and Monroe Street: <br />Dr. Varner called for a presentation on Bill No. 03-09 requesting a vacation of an alley and portion of a <br />street right of way involving Main Street, Western Avenue, Michigan Street and Monroe Street. <br />Michael J. Danch, President of Danch, Harner & Associates, Inc. with offices located at 1643 Commerce <br />Drive, South Bend, Indiana 46628 made the formal presentation. He noted that the Petitioners who <br />include the City of South Bend, the Redevelopment Department, the Western Avenue Properties LLC, <br />Diaz Regelio, Luis Sotelo and Marie Luisa are seeking a vacation of two (2) 14' alleys and a portion of <br />Michigan Street located near the Bankruptcy Courthouse. The vacation would allow the property owners <br />to reconfigure the existing lots. Mr. Danch added that Homeland Security is in the process of increasing <br />security guidelines and this would permit that to also go forward. <br />Council Member White noted that the Board of Public Works sent the request to the Council with a <br />favorable recommendation. <br />There was no one in the public to speak in favor or in opposition to the Bill. <br />Council Member Rouse made a motion, seconded by Council Member LaFountain that Bill No. 03-09 be <br />recommended favorably to Council.
