• <br /> ORDINANCE NO. 021 / 6 <br /> AN ORDINANCE A : ?DING SECTTION ONE OF ORDINANCE <br /> NUMBER 2670 flHICH IS AN ORDINANCE AMENDING <br /> ORDINANCE 2243 COTei==ONLY iUTO;; d AS THE <br /> BUILDING CODE. <br />• <br /> --000-- <br /> BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH <br /> BEND, INDIANA: <br /> SECTION 1. That ordinance Number 2670 be amended so that <br /> • <br /> sub-section 601-A of Ordinance 2243, commonly known as the Building <br /> Code of the City of South Bend , Indiana, shall read as follows: <br /> Section 1. 601-A. As a precautionary measure against <br /> fire and an explosive 'hazard, it is hereby declared unlawful <br /> and is prohibited to install within the city limits of <br /> South Bend, either above or below ground, tankage for the <br /> storage of inflammable liquids of classes I and II as de- <br /> fined by section 570 of Ordinance No. 2243 where the <br /> • combined capacities of such tankage shall exceed five <br /> thousand (5000) gallons at any one location. <br /> The word location as used herein shall mean the <br /> occupation and use of an area occupied by such storage <br /> and tankage, and the area surrounding within a radius <br /> of one hundred fifty (150) feet from said tankage, or, <br /> if a public street intervenes within one hundred fifty <br /> (150) feet, then to such public street . This ordinance <br /> shall not affect existing locations and uses made there- <br /> of; Provided, however, that in event and at the time <br /> of the determination of the locations now existing, and <br /> a discontinuance of the use for storage purposes now <br /> thereof made, which would otherwise fall within the <br /> terms of this ordinance where such cessation of use <br /> shall extend over a period in excess of six (6) months, <br />• the re-establishment of such use shall be prohibited <br /> except conformable to this ordinance ; And. provided. <br /> further, that where any area occupied for storage tank <br /> purposes is appropriated for public use, such storage <br /> plant may be moved to another and different location <br /> in' the City of 'South Bend in compliance with the laws <br /> and regulations of the State of Indiana and the ordinances <br /> of this City. • <br /> SECTION 2.
