REGULAR MEETING NOVEMBER 11, 2013 <br /> Be it remembered that the Common Council of the City of South Bend, Indiana met in the <br /> Council Chambers of the County-City Building on Monday,November 11, 2013 at 7:00 p.m. <br /> The meeting was called to order by Council President Derek Dieter and the Invocation and <br /> Pledge to the Flag were given. <br /> ROLL CALL <br /> COUNCILMEMBERS: <br /> Present: Tim Scott 1s` District <br /> Henry Davis, Jr. 2nd District (7:01) <br /> Valerie Schey 3rd District <br /> Fred Ferlic 4th District <br /> David Varner 5th District <br /> Oliver J. Talboom Deputy <br /> Mary Beth Wisniewski Chief Deputy <br /> Kathleen Cekanski-Farrand Council Attorney <br /> REPORT FROM THE SUB-COMMITTEE ON MINUTES <br /> Councilmember Schey made a motion that the minutes of the October 28, 2013, meeting of the <br /> Council be accepted and placed on file. Councilmember Oliver Davis seconded the motion <br /> which carried by a voice vote of nine (9) ayes. <br /> SPECIAL BUSINESS <br /> ANNOUNCEMENT: REPRESENTING THE CITY ADMINISTRATION WILL BE CITY <br /> CONTROLLER MARK NEAL <br /> Council Attorney Kathleen Cekanski-Farrand announced that at the Special Common Council <br /> meeting held on Wednesday, Substitute Bill No. 53-13 was amended with City Clerk John <br /> Voorde reading into the record information from the recommendations received from individual <br /> Councilmembers summarized. As noted that evening, the proposed salary for the Deputy Mayor <br /> could not be higher than that proposed by the Mayor, per governing state law. In working with <br /> Mark Neal and John Murphy, we noticed that the position of Forester"was read as receiving a <br /> 7% increase. However, in light of the same state law, namely Indiana Code §36-4-7-3(b) which <br /> prohibited the Deputy Mayor position to receive more than what was proposed by the Mayor, the <br /> "Forester" is limited to the Mayor's recommendation of 3.56% <br /> REPORTS OF CITY OFFICES <br /> There were no reports of City Office at this time. <br /> RESOLVE INTO THE COMMITTEE OF THE WHOLE <br /> At 7:03 p.m. Councilmember Oliver Davis made a motion to resolve into the Committee of the <br /> Whole. Councilmember Varner seconded the motion which carried by a voice vote of nine (9) <br /> ayes. Councilmember White, Chairperson, presiding. <br /> Councilmember White, explained the procedures to be followed for tonight's meeting in <br /> accordance with Article 1, Section 2-11 of the South Bend Municipal Code. <br />
