REGULAR MEETING NOVEMBER 11, 2013 Be it remembered that the Common Council of the City of South Bend, Indiana met in the Council Chambers of the County-City Building on Monday,November 11, 2013 at 7:00 p.m. The meeting was called to order by Council President Derek Dieter and the Invocation and Pledge to the Flag were given. ROLL CALL COUNCILMEMBERS: Present: Tim Scott 1s` District Henry Davis, Jr. 2nd District (7:01) Valerie Schey 3rd District Fred Ferlic 4th District David Varner 5th District Oliver J. Davis 6th District, Vice-President Derek Dieter At-Large, President Gavin Ferlic At-Large Karen L. White At-Large, Chairperson Committee of the Whole OTHERS PRESENT: John Voorde City Clerk Janice I. Talboom Deputy Mary Beth Wisniewski Chief Deputy Kathleen Cekanski-Farrand Council Attorney REPORT FROM THE SUB-COMMITTEE ON MINUTES Councilmember Schey made a motion that the minutes of the October 28, 2013, meeting of the Council be accepted and placed on file. Councilmember Oliver Davis seconded the motion which carried by a voice vote of nine (9) ayes. SPECIAL BUSINESS ANNOUNCEMENT: REPRESENTING THE CITY ADMINISTRATION WILL BE CITY CONTROLLER MARK NEAL Council Attorney Kathleen Cekanski-Farrand announced that at the Special Common Council meeting held on Wednesday, Substitute Bill No. 53-13 was amended with City Clerk John Voorde reading into the record information from the recommendations received from individual Councilmembers summarized. As noted that evening, the proposed salary for the Deputy Mayor could not be higher than that proposed by the Mayor, per governing state law. In working with Mark Neal and John Murphy, we noticed that the position of Forester"was read as receiving a 7% increase. However, in light of the same state law, namely Indiana Code §36-4-7-3(b) which prohibited the Deputy Mayor position to receive more than what was proposed by the Mayor, the "Forester" is limited to the Mayor's recommendation of 3.56% REPORTS OF CITY OFFICES There were no reports of City Office at this time. RESOLVE INTO THE COMMITTEE OF THE WHOLE At 7:03 p.m. Councilmember Oliver Davis made a motion to resolve into the Committee of the Whole. Councilmember Varner seconded the motion which carried by a voice vote of nine (9) ayes. Councilmember White, Chairperson, presiding. Councilmember White, explained the procedures to be followed for tonight's meeting in accordance with Article 1, Section 2-11 of the South Bend Municipal Code.
