� (, ( <br /> ORDINANCE NO. <br /> AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, <br /> INDIANA, <br /> AMENDING OF CHAPTER 6,ARTICLE 4, SECTION 6-10 (d)(2) OF THE SOUTH <br /> BEND MUNICIPAL CODEADDRESSING PLUMBING EXCAVATOR FEES <br /> CHARGED BY THE BUILDING DEPARTMENT <br /> STATEMENT OF PURPOSE AND INTENT <br /> Recently, on October 26, 2015, the South Bend Common Council enacted Ordinance No. <br /> 10394-15 (Bill No. 67-15)which adjusted various permit and contractor registration fees charged by <br /> the consolidated Building Department of the City of South Bend and St.Joseph County. This was <br /> done to assure that revenue from fees and services collected by the Building Department is adequate <br /> for effective operation. <br /> It has been brought to the Council's attention that fees for registration of excavators, as <br /> defined in the South Bend Municipal Code, Chapter 6,Article 4, Section 6-10(d)(1)b, were not <br /> increased to $125.00,unlike the fees for other contractors,and that this omission was unintentional. <br /> Adjustment of the excavator registration fees from one hundred dollars ($100.00) to one hundred <br /> twenty-five dollars ($125.00) is necessary to correct this oversight and assure that all contractors are <br /> treated equally. <br /> Adjustment of the fees as provided in this ordinance is in the best fiscal interest of <br /> the City of South Bend. <br /> NOW,THEREFORE, BE IT ORDAINED by the Common Council of the City of <br /> South Bend, Indiana, as follows: <br /> Section I. Chapter 6,Article 4, Section 6-10 (d)(2) b of the South Bend Municipal Code shall <br /> be amended to read as follows: <br /> (d) Registration and permits for plumbing services. <br /> (2) Registration required: <br /> a. All persons performing plumbing services within the City shall be a Plumbing <br /> contractor and shall register with the Department;provided,however, that the <br /> owner-occupant of a dwelling shall not be required to register when he or she is <br /> installing altering or repairing the plumbing of that dwelling. <br /> b. Registration shall be on forms provided by the Department and shall be <br /> accompanied by payment of a registration fee,as follows: <br /> Plumbing contractors $125.00 <br /> Excavators (as defined in Ssection 6-10(d)(1)b_). 480:00 125.00 <br /> Sewer cleaners .... 125.00 <br />
