RESOLUTION NO. 1n 3 7-f3 <br /> RESOLUTION OF THE COMMON COUNCIL OF THE CITY <br /> OF SOUTH BEND APPROVING THE EAST BANK DEVELOP- <br /> MENT PLAN, AS AMENDED, AND FURTHER AMENDING <br /> THE DEVELOPMENT PLAN. <br /> WHEREAS, the City of South Bend Redevelopment Commission <br /> ( "Commission" ) , pursuant to the Redevelopment of Cities and Towns <br /> Act of 1953 , as amended ( 36-7-14 ) (the "Act" ) , has conducted sur- <br /> veys and investigations and has thoroughly studied the area in <br /> the City of South Bend, County of St. Joseph, State of Indiana, <br /> and designated the area as the "East Bank Development Area" (the <br /> "Area" ) , which Area is more particularly described as follows : <br /> A parcel of land being a part of the City of <br /> South Bend, Portage Township, St. Joseph <br /> County, Indiana and being more particularly <br /> described as follows, viz : <br /> Beginning at the point of intersection of the <br /> North-right-of-way line of Sorin Street with <br /> the East right-of-way line of Niles Avenue in <br /> Said City; thence South along said East right- <br /> of-way line of Niles Avenue to the centerline <br /> of the first fourteen ( 14 ) foot alley lying <br /> North of Cedar Street and between Niles Avenue <br /> and Hill Street; thence East along said center- <br /> line, to the centerline of Hill Street, a sixty- <br /> six ( 66 ) foot right-of-way; thence South, along <br /> said Hill Street centerline, to the centerline <br /> of Jefferson Boulevard; an eighty-two and one- <br /> half ( 82 . 5 ) foot right-of-way; thence West, <br /> along said Jefferson Boulevard centerline to <br /> the center of the St. Joseph River; thence <br /> in a Northwesterly and Northeasterly direction <br /> along the centerline of said River to its inter- <br /> section with the projected North right-of-way <br /> line of said Sorin Street; thence East, along <br /> said projection and along said North right-of- <br /> way line to the East right-of-way line of Niles <br /> Avenue which is the place of beginning. <br /> WHEREAS, the Commission has made detailed studies of the <br /> location, physical condition of structures, land use, environ- <br /> mental influences, and the social , cultural , and economic <br /> conditions of the Area and has determined that the Area is a <br /> blighted area and that it constitutes a menace to the social <br /> and economic interests of the City of South Bend and its inhabi- <br /> tants and it would be of public utility and benefit to acquire <br /> real estate in such Area and redevelop the Area under the pro- <br /> visions of the Act; and <br /> WHEREAS, the Commission approved a Development Plan for the <br /> Area dated October 3 , 1980 and amended on December 18, 1980 en- <br /> titled "East Bank Development Area, Development Plan, South Bend, <br /> Indiana" , consisting of 24 pages (the "Development Plan" ) , which <br /> has been submitted to the Common Council for review and approval ; <br /> and <br /> WHEREAS, the Commission has adopted its Declaratory Resolu- <br /> tion No. 678 on March 11 , 1983 , redeclaring the Area to be blight- <br /> ed and adding parcels to the acquisition list; and <br />
