(62) Regulatory flood means the flood having a one percent(1%) chance of being <br /> equaled or exceeded in any given year, as calculated by a method and procedure <br /> that is acceptable to and approved by the Indiana Department of Natural Resources <br /> and the Federal Emergency Management Agency. The regulatory flood elevation at <br /> any location is as defined in Section 21-12.03 (2) of this Article. The "Regulatory <br /> Flood" is also known by the term "Base Flood", "One-Percent Annual Chance <br /> Flood",and "100-Year Flood". <br /> (63) Repetitive loss means flood-related damages sustained by a structure on two <br /> separate occasions during a 10-year period for which the cost of repairs at the time <br /> of each such flood event, on the average,equaled or exceeded 25%of the market <br /> value of the structure before the damage occurred. <br /> (64) Section 1316 is that section of the National Flood Insurance Act of 1968, as <br /> amended, which states that no new flood insurance coverage shall be provided for <br /> any property that the Administrator fords has been declared by a duly constituted <br /> state or local zoning authority or other authorized public body to be in violation of <br /> state or local laws, regulations, or ordinances that intended to discourage or <br /> otherwise restrict land development or occupancy in flood-prone areas. <br /> (65) Special Flood Hazard Area (SFHA)means those lands within the jurisdiction of <br /> the City of South bend, Indiana subject to inundation by the regulatory flood. The <br /> SFHAs of the City of South Bend are generally identified as such on the St. Joseph <br /> County, Indiana and Incorporated Areas Flood Insurance Rate Map dated January <br /> 6, 2011 as well as any future updates, amendments, or revisions,prepared by the <br /> Federal Emergency Management Agency with the most recent date. (These areas <br /> are shown on a FIRM as Zone A, AE,Al- A30,AH,AR, A99, or AO). <br /> (66) Start of construction includes substantial improvement,and means the date the <br /> building permit was issued,provided the actual start of construction, repair, <br /> reconstruction, or improvement was within 180 days of the permit date. The actual <br /> start means either the first placement of permanent construction of a structure on a <br /> site, such as the pouring of a slab or footings, the installation of piles,the <br /> construction of columns, or any work beyond the stage of excavation; or the <br /> placement of a manufactured home on a foundation. Permanent construction does <br /> not include land preparation, such as clearing,grading and filling; nor does it <br /> include the installation of streets and/or walkways; nor does it include excavation <br /> for a basement, footings,piers, foundations, or the erection of temporary forms; nor <br /> does it include the installation on the property of accessory buildings, such as <br /> garages or sheds not occupied as dwelling units or not part of the main structure. <br /> For a substantial improvement,the actual start of construction means the first <br /> alteration of any wall, ceiling, floor, or other structural part of a building, whether <br /> or not that alteration affects the external dimensions of the building. <br /> (67) Structure means a structure that is principally above ground and is enclosed by <br /> walls and a roof.
