BILL NO. SUBSTITUTE ORDINANCE <br /> ORDINANCE NO. <br /> AN ORDINANCE INITIATED BY THE AREA PLAN COMMISSION OF ST. JOSEPH <br /> COUNTY, INDIANA ON BEHALF OF THE COMMON COUNCIL OF THE CITY OF <br /> SOUTH BEND, INDIANA,AMENDING CHAPTER 21 ZONING OF THE MUNICIPAL <br /> CODE OF THE CITY OF SOUTH BEND, INDIANA BY REPEALING AND REPLACING <br /> ARTICLE 12 FLOODPLAIN REGULATIONS, IN ORDER TO ADOPT THE MOST RECENT <br /> FEDERAL AND STATE REQUIREMENTS. <br /> STATEMENT OF PURPOSE AND INTENT <br /> The purpose of this ordinance is to amend Chapter 21 of the South Bend Municipal Code, <br /> Article 12 Floodplain Regulations to reflect changes as required by the Federal Emergency <br /> Management Agency(FEMA). This ordinance has been recommended for approval by the Area <br /> Plan Commission of St. Joseph County, Indiana, and is substantially equivalent to ordinances <br /> being adopted by all other participating political subdivisions of St. Joseph County, Indiana. <br /> The Common Council of the City of South Bend recognizes its duty to enact amendments <br /> to the Floodplain Regulations in order to continue to qualify for participation in the National <br /> Flood Insurance Program. <br /> The Common Council further recognizes that a study of the flood-prone areas in the City <br /> of South Bend, Indiana, has been prepared and published by the Federal Emergency <br /> Management Agency, and identifies the floodplains, floodways and floodway fringe areas within <br /> the City in conjunction with the National Flood Insurance Program. <br /> NOW, THEREFORE, be it ordained by the Common Council of the City of South Bend, <br /> Indiana, as follows: <br /> SECTION I. CHAPTER 21 ZONING,ARTICLE 12 FLOODPLAIN REGULATIONS, <br /> of the Municipal Code of the City of South Bend, Indiana, shall be deleted in its entirety. <br /> SECTION II. CHAPTER 21 ZONING, of the Municipal Code of the City of South <br /> Bend, Indiana, shall be amended by adding new ARTICLE 12 FLOODPLAIN REGULATIONS <br /> to read in its entirety as follows: <br />
