Staff Report 10/7/2015 <br /> Utilities: <br /> Since the site will be used for retention only, it will not be utilizing any water or sanitary <br /> systems. The larger development site will be served by municipal water and sewer. <br /> Agency Comments: <br /> County Surveyor,County Engineer, and County Health Department recommend approval. <br /> City Engineer recommends approval, subject to a final drainage plan. <br /> Commitments: <br /> The petitioner is not proposing any written commitments. <br /> Criteria to be considered in reviewing rezoning requests, per IC 36-7-4-603: <br /> 1. Comprehensive Plan: <br /> Policy Plan: <br /> This rezoning petition is consistent with City Plan, South Bend Comprehensive Plan <br /> (November 2006): Policy PF 7.1.1: Support the provision of services that effectively meet <br /> the changing healthcare needs of residents. <br /> Land Use Plan: <br /> The Future Land Use Map identifies this area as commercial (office&retail). <br /> Plan Implementation/Other Plans: <br /> There are no other plans in effect for this area. <br /> 2. Current Conditions and Character: <br /> The area north of Cleveland Road between Portage Road and Riverside Drive have seen a <br /> gradual transition to commercial uses beginning in the late 1980's. Since that time, several <br /> properties with access to Cleveland have zoned to various forms of commercial districts. <br /> In the immediate proximity of this site,a funeral home and beauty salon have developed. <br /> This site will be adjacent and accessory to a site to the southwest which was rezoned to 0 <br /> Office District in 1990,then to CB Community Business District in 2008. <br /> 3. Most Desirable Use: <br /> The most desirable use is one that supports commercial growth while limiting any <br /> negative impact on surrounding residential properties. <br /> 4. Conservation of Property Values: <br /> Due to the low-impact nature of a retention basin,surrounding property values should not <br /> be adversely affected. <br /> 5. Responsible Development And Growth: <br /> It is responsible growth and development to allow the adjacent medical complex to utilize <br /> this property for a drainage basin. <br /> Staff Comments: <br /> The staff has no additional comments. <br /> APC # 2758-15 Page 2 of 3 <br />
