RESOLUTION NO. w9 -gq <br /> A RESOLUTION CONFIRMING THE ADOPTION OF A DECLARATORY <br /> RESOLUTION DESIGNATING CERTAIN AREAS WITHIN THE CITY <br /> OF SOUTH BEND, COMMONLY KNOWN AS 3607 SOUTH MAIN STREET <br /> TO BE AN ECONOMIC REVITALIZATION AREA FOR PURPOSES OF <br /> REAL PROPERTY TAX ABATEMENT. <br /> WHEREAS, the Common Council of the City of South Bend <br /> has adopted a Declaratory Resolution designating certain areas <br /> within the City as Economic Revitalization Areas for the pur- <br /> pose of tax abatement consideration; and <br /> WHEREAS , a Declaratory Resolution designated the area <br /> commonly known as 3607 South Main Street, and more particularly <br /> described as follows : <br /> Lots 1 thru 5 as shown on the plat of Ida M. Walz ' s Subdivision <br /> to the City of South Bend , Indiana recorded October 13 , 1938 in <br /> Plat Book 14, page W-5 and Lots "D" and "E" as shown on the <br /> plat of John E. Walz ' s Revised Addition to the City of South <br /> Bend recorded June 28, 1928 in Plat Book 12, page 196 together <br /> with vacated Lafayette Boulevard and vacated alleys lying <br /> between and adjacent to above said recorded lots and also a <br /> parcel of land 28 feet North and South by 211 .75 feet , more or <br /> less, East and West in the Southwest 1/4 of the Southwest 1/4 <br /> of Section 24 , Township 37 North, Range 2 East , Portage Town- <br /> ship, City of South Bend, County of St. Joseph, Indiana lying <br /> South and adjacent to above said recorded plats, the above com- <br /> bined tract being more particularly described as follows: <br /> Beginning at the Northeast corner of Lot 1 as shown on said <br /> recorded plat of Ida M. Walz ' s Subdivision, said point being <br /> the Southwest corner of Main Street and Sherwood Street; thence <br /> West along the South line of Sherwood Street 465.85 feet to a <br /> point 7 feet East of the West line of said Section 24 , being <br /> also the East line of a 7 foot alley; thence South along said <br /> East line of alley 246 . 6 feet to the South line of said John E. <br /> Walz 's Revised Addition; thence East along said South line <br /> 234 .55 feet to a point 211 .75 feet West of the West line of <br /> Main Street, as now established; thence South 28 feet; thence <br /> East parallel with the South line of said recorded plat of John <br /> E. Walz 's Revised Addition 209.82 feet to the West line of Main <br /> Street; thence Northeasterly along said West line of Main <br /> Street 282.92 feet to the point of beginning . <br /> as an Economic Revitalization Area; and <br /> WHEREAS, notice of the adoption of a Declaratory Reso- <br /> lution and the public hearing before the Council has been pub- <br /> lished pursuant to Indiana Code 6-1. 1-12.1-2-5, and <br /> WHEREAS, the Council held a public hearing for the <br /> purposes of hearing all remonstrances and objections from <br /> interested persons; and <br /> WHEREAS, the Council has determined that the qualifi- <br /> cations for an economic revitalization area have been met . <br /> NOW THEREFORE, BE IT RESOLVED by the Common Council of <br /> the City of South Bend, Indiana, as follows : <br /> SECTION I . That the Common Council hereby confirms <br /> its Declaratory Resolution designating the area described <br /> herein as an Economic Revitalization Area for the purposes of <br /> tax abatement. Such designation is for real property tax <br /> abatement only and is limited to ten (10) calendar years from <br /> the date of adoption of the Declaratory Resolution by the Com- <br /> mon Council. <br />
