RESOLUTION NO. f a4Q-ts- <br /> A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND <br /> AUTHORIZING THE EXECUTION OF AN AGREEMENT FOR HAZARDOUS MATERIAL <br /> INCIDENT RESPONSE SERVICES BETWEEN THE CITY OF SOUTH BEND <br /> AND THE INDIANA DEPARTMENT OF HIGHWAYS <br /> WHEREAS, the Common Council of the City of South Bend recognizes the <br /> existence of the South Bend Fire Department Hazardous Materials Incident <br /> Response Team consisting of trained personnel and equipment for response <br /> to HAZMAT incidents ; and <br /> WHEREAS, because of an increase in vehicular traffic transporting <br /> hazardous materials on the Toll Road, the Indiana Department of Highways <br /> wishes to obtain the services of the South Bend Fire Department Hazardous <br /> Materials Incident Response Team for response, assessment and control of <br /> hazardous materials (HAZMAT) incidents occurring within its jurisdiction; <br /> and <br /> WHEREAS, I. C. 36-1-7-1 et. seq. permits governmental entities to <br /> exercise powers jointly by entering into a written agreement. <br /> WHEREAS, the Board of Public Safety on January 8, 1985 , has reviewed <br /> this request of the Indiana Department of Highways and recommends that the <br /> Common Council enter into an Agreement for Hazardous Materials Incident <br /> Response Services with the Indiana Department of Highways, Toll Road <br /> Division. <br /> NOW, THEREFORE, BE IT RESOLVED, by the Common Council of the City of <br /> South Bend, Indiana, as follows : <br /> SECTION I. That the Common Council of the City of South Bend enter <br /> into an Agreement with the Indiana Department of Highways for Hazardous <br /> Materials Incident Response Services and the President of the Common <br /> Council be authorized to execute the appropriate Agreement necessary to <br /> carry out the request of the Indiana Department of Highways and intent of <br /> this resolution. <br /> SECTION II. This Resolution shall be in full force and effect from <br /> and after its adoption by the Common Council and approval by the Mayor. <br /> Ate <br /> ember of the Co .
