RESOLUTION NO. 1,)g$-gs <br /> A RESOLUTION OF THE COMMON COUNCIL OF THE <br /> CITY OF SOUTH BEND, INDIANA, URGING THE CITY <br /> ADMINISTRATION TO PROVIDE LEADERSHIP IN <br /> AMICABLY RESOLVING THE CURRENT NOISE AND ODOR <br /> PROBLEMS OF THE ETHANOL PLANT <br /> WHEREAS, the Cannon Council of the City of South Bend, Indiana, is <br /> very much aware of the public concerns being voiced about current noise <br /> and odor problems of the ethanol plant; and <br /> WHEREAS, the Council is also very concerned that the New Energy <br /> Corporation be given adequate time to investigate and implement changes <br /> which are deemed necessary to correct their current problems; and <br /> WHEREAS, because the Council believes that the City must strike a <br /> reasonable balance between the concerns of our citizens and those of <br /> the economic and business community in order that continued progress be <br /> made in our City; and <br /> WHEREAS, the Council recognizes that the ultimate authority in <br /> this area rests with the City Administration, and therefore encourages <br /> it to cooperate with the Council and the Technical Committee so that it <br /> will provide the leadership necessary to amicably resolve the current <br /> noise and odor problems of the ethanol plant in a timely manner; and <br /> WHEREAS, the Council ultimately believes that through the spirit <br /> of cooperation, the City Administration will be able to protect our <br /> high quality of life and encourage the New Energy Corporation to take <br /> all steps necessary to resolve their noise and odor problems. <br /> NOW, THEREFORE BE IT RESOLVED, by the Common Council of the City <br /> of South Bend, Indiana, as follows: <br /> SECTION I. The Common Council urges the City Administration to <br /> continue to work through the Mayor's Technical Committee to timely <br /> resolve the current noise and odor problems of the ethanol plant. <br /> SECTION II. Since the Council realizes that the ultimate <br /> authority in this area rests with the City Administration, it requests <br /> that in the event that the problems are not resolved, that it <br /> investigate what legal action may be most appropriate in order to <br /> protect the high quality of life in our community. <br /> SECTION III. The Council urges the City Administration to keep <br /> the Council advised on a regular and consistent basis of all major <br /> issues and of the timetable it believes is most reasonable to correct <br /> these problems. <br /> SECTION IV. This Resolution shall be in full force and effect <br /> from and after its adoption by the Cannon Council and approval by the <br /> Mayor. <br /> ,_ /� 1 <br /> Jose 4 T.
