REGULAR MEETING OCTOBER 13, 2015 354 <br />UNFAVORABLE RECOMMENDATION - PETITION TO VACATE THE NORTH SOUTH <br />AND EAST/WEST ALLEYS BETWEEN ORANGE ST., LINDEN AVE. BROOKFIELD ST <br />AND JACKSON ST. <br />Mr. Gilot indicated that Ray Saenz, 921 West Colfax, South Bend, Indiana 46601, has submitted <br />a request to vacate the above referenced alleys. Mr. Gilot advised the Board is in receipt of <br />favorable recommendations concerning this Vacation Petition from the Police Department, Fire <br />Department, and Engineering Department. Area Plan Commission gave a favorable <br />recommendation subject to removal of the portion adjacent to Orange St. and the first East/West <br />alley that petitioner does not own. Area Plan stated the vacation would not hinder the growth or — <br />orderly development of the unit or neighborhood in which it is located or to which it is <br />contiguous. The vacation would make access to the lands of the aggrieved person by means of <br />public way difficult or inconvenient. The vacation would not hinder the public's access to a <br />church, school or other public building or place. The vacation would not hinder the use of a <br />public right-of-way by the neighborhood in which it is located or to which it is contiguous. Ms. <br />Maradik, Community Investment, noted the petitioner does not own all of the properties bounded <br />by the alleys and there are some garages that have access through the alleys. After review of the <br />map, Board members determined the petitioner does not own half of the properties and therefore <br />should not be petitioning to vacate for the purpose of consolidating their property. Therefore, Mr. <br />Relos made a motion to give an unfavorable recommendation for the request for vacation. Ms. <br />Maradik seconded the motion which carried. <br />UNFAVORABLE RECOMMENDATION - PETITION TO VACATE THE NORTH/SOUTH <br />AND EAST/WEST ALLEYS BETWEEN JEFFERSON BLVD., NAPIER ST., CHERRY ST., <br />AND CHESTNUT ST. <br />Mr. Gilot indicated that Ray Saenz, 921 West Colfax, South Bend, Indiana 46601, has submitted <br />a request to vacate the above referenced alleys. Mr. Gilot advised the Board is in receipt of <br />favorable recommendations concerning this Vacation Petition from the Area Plan Commission, <br />Police Department, Fire Department, and Solid Waste. Engineering recommends against <br />vacating the east/west alley at Cherry St. unless a turnaround is provided or Cherry is also <br />vacated so as not to leave a dead-end. Area Plan stated the vacation would not hinder the growth <br />or orderly development of the unit or neighborhood in which it is located or to which it is <br />contiguous. The vacation would not make access to the lands of the aggrieved person by means <br />of public way difficult or inconvenient. The vacation would not hinder the public's access to a <br />church, school or other public building or place. The vacation would not hinder the use of a <br />public right-of-way by the neighborhood in which it is located or to which it is contiguous. Ms. <br />Maradik, Community Investment, noted the petitioner only owns half of the properties and the <br />City owns one of the vacant lots. She added there are several homes that access their garages <br />through the alley. After review, the Board determined that the petitioner did not own all of the <br />properties and should not be petitioning to vacate the alley to consolidate property. Therefore, <br />Mr. Glot made a motion to give an unfavorable recommendation for the request for vacation. <br />Mr. Relos seconded the motion which carried. <br />FAVORABLE RECOMMENDATION - PETITION TO VACATE THE FIRST NORTH <br />SOUTH ALLEY SOUTH OF MISIIAWAKA AVENUE TO THE FIRST EAST/WEST ALLEY <br />BETWEEN 28Tn & 29Ttt STREETS <br />Mr. Gilot indicated that Chester Arch Services on behalf of Family Pet Health Center, 2910 <br />Mishawaka Avenue, South Bend, Indiana, has submitted a request to vacate the above referenced <br />alley for the purpose of consolidating the parking lot for the property. Mr. Gilot advised the <br />Board is in receipt of favorable recommendations concerning this Vacation Petition from the <br />Area Plan Commission, Police Department, Fire Department, and Community Investment. Mr. <br />Gilot advised the Board is in receipt of unfavorable recommendations concerning this Vacation <br />Petition from Solid Waste and Engineering. Solid Waste stated the vacation would hinder trash — <br />collection in the alley between 28" and 29" Streets. Engineering stated the request is to vacate a <br />16' wide alley, which would terminate the alley at a 12' wide perpendicular section, but 14' is <br />the narrowest alley Engineering will recommend. Engineering recommended that the requestor <br />provide for vehicular turning by increasing the width of the perpendicular alley circuit. <br />Therefore, Mr. Gilot made a motion recommending approval of the request for vacation subject <br />to working out the details with Engineering. Mr. Relos seconded the motion which carried. <br />APPROVE TRAFFIC CONTROL DEVICES <br />Upon a motion made by Mr. Gilot, seconded by Ms. Maradik and carried, the following traffic <br />control devices were approved: <br />
