Board of Zoning Appeals -January 15, 2009 <br />MR. BAXTER: 32 at the moment. It used to be at 26 and I think a few years ago it was raised to 32. Some <br />where is the toughest. time for people on the street or when it's above 32 and it's still cold like in the 30's and <br />the low 40's. <br />MR. HOFFMAN: Jeff, this is for you. I'm reading ahead here. Do we have any legal issues with the term <br />weather amnesty? <br />MR. JANKOWSKI: No because that would be the only time that this would be operable. <br />MR. HOFFMAN: Right and that is defined, so. <br />MR. JANKOWSKI: And that would be included in whenever you're making a recommendation or no <br />recommendation. And that would be included in whatever it is that you decide that it would be limited to a <br />declaration of weather amnesty by somebody. I don't know who that is. <br />MR. HOBAN: Yeah who defines weather amnesty? Is that a Federal thing or local...? <br />MR. JANKOWSKI: I don't know. I don't know the answer to that. I don't know where that standard comes <br />from, that's what I'm concerned about also. <br />MR. HOFFMAN: Because it's not necessary defined as a weather emergency, where the Mayor would step <br />in. <br />MR. JANKOWSKI: The Mayor can declare a weather.emergency. The Commissioner would declare some <br />sort of weather emergency where you talk about the heating centers would kick in. Where weather amnesty <br />kicks in, I don't know who makes that declaration. <br />MR. HOBAN: Do you have an answer on that. I'll allow you to come back up to the podium again if you'll <br />wish. <br />MR. BAXTER: My understanding is weather amnesty is a program that was instituted by the social, by a <br />network of social agencies downtown under the auspices of what they call the continuum care. So basically <br />'the social agencies have decided that they would work together and have an order for people, you know how <br />many are taken at which agency and that they in somev,~hat an informal way determine what's appropriate to <br />take people in over night. The emergency overnight that people are taking about now because of the cold, is <br />something I think is something that occurs through the Mayor's office of Mishawaka and South Bend as well <br />as the County Commissioners. Where they declare a cold emergency and then all sorts of restrictions are held <br />in advance for that time. The only reason I know this is because people are talking about now, the last few <br />-days. I might not be entirely accurate about but I think we are talking about two different things with the <br />formally declared weather emergency and the weather formally agreed upon amnesty by the agencies <br />downtown. <br />IN FAVOR <br />MR.
