JEFFERSON BLVD., ROOM 1140 COUNTY•CITY BUILDING, SOUTH BEND, INDIANA 46601 (574) 235-9571 <br /> Wednesday,September 16,2015 <br /> The Honorable Council of the City of South Bend <br /> 4th Floor,County-City Building <br /> South Bend, IN 46601 <br /> RE: A proposed ordinance of Earth Designs Real Estates LLC to zone from PUD Planned Unit Development <br /> District to GB General Business District for Parcel 1, property located north of and adjacent to Hickory Road, <br /> and to PUD Planned Unit Development District for Parcel 2, property located west of and adjacent to 3515 <br /> McKinley,City of South Bend-APC#2753-15.-APC#2753-15. <br /> Dear Council Members: <br /> I hereby Certify that the above referenced ordinance of Earth Designs Real Estates LLC was legally advertised on <br /> Thursday, September 03, 2015 and that the Area Plan Commission at its public hearing on Tuesday, September 15, <br /> 2015 took the following action: <br /> Upon a motion by Robert Hawley, being seconded by Phil Sutton and unanimously carried,the <br /> proposed ordinance of Earth Designs Real Estates LLC to zone from PUD Planned Unit Development <br /> District to GB General Business District for Parcel I, property located north of and adjacent to <br /> Hickory Road,and to PUD Planned Unit Development District for Parcel 2,property located west of <br /> and adjacent to 3515 McKinley,City of South Bend-APC#2753-I5., is sent to the Common Council <br /> with a FAVORABLE recommendation. This has been a difficult site for the private market to develop. <br /> Any one zoning district would limit the site's ability to be utilized for the wide range of demands <br /> sought. The rezoning of this site to a new and revised PUD allows flexibility in the design and use of <br /> the site,while adding appropriate protection to the surrounding residential areas. <br /> The deliberations of the Area Plan Commission and points considered in arriving at the above decision are shown <br /> in the minutes of the public hearing, and will be forwarded to you at a later date to be made a part of this report. <br /> Sincerelyn <br /> P ,c7/ . <br /> Lawrence P.
