A RESOLUTION OF THE COMMON COUNCIL OF THE
CITY OF SOUTH BEND, INDIANA
APPROVING A PETITION OF THE SOUTH BEND
BOARD OF ZONING APPEALS
FOR THE PROPERTY LOCATED AT
3003 LINCOLNWAY WEST, SOUTH BEND, INDIANA
WHEREAS, Indiana Code Section 36-7-4-918.6, requires the Common Council to give notice
pursuant to Indiana Code Section 5-14-1.5-5, of it's intention to consider Petitions from the Board of
Zoning Appeals for approval or disapproval; and
Whereas, the Common Council must take action within thirty (30) days after the boazd of
Zoning Appeals makes it's recommendation to the Council; and
Whereas, the Common Council is required to make a determination in writing on such requests
pursuant to Indiana Code Section 36-7-4-918.4; and
Whereas, the South Bend Board of Zoning Appeals has made a recommendation, pursuant to
applicable state law.
NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF
SOUTH BEND, INDIANA, as follows:
SECTION I. The Common Council has provided notice of the hearing on the Petition from the
Board of Zoning Appeals pursuant to Indian Code Section 5-14-1.5-5, requesting that a special
exception be granted for the property located at 3003 Lincolnway West to have a Special Exception
Use to allow parking in a MU Mixed Use District which will serve an Office in CB Community
Business District and a Special Exception Use to allow off site parking for the Office on the MU
Mixed Use pazcel. Also, seeking a pazking lot setback variance from the required 20' setback to 5'
along Terrace Avenue and Lincolnway West.
SECTION II. Following a presentation by the Petitioner, and after proper public hearing, the
Common Council hereby approves the Petition of the South bend Board of Zoning Appeals, a copy of
which is on file in the Office of the City Clerk.
SECTION III. The Common Council of the City of South bend, Indiana, hereby find that:
1. The approval will not be injurious to the public health, safety, morals, and general
welfare of the community;
2. The use and value of the area adjacent to the property included in the special
exception will not be affected in a substantially adverse manner;
3. The need for the special exception arises from specific conditions peculiar to the
property involved;
4. The strict application of the terms of the Zoning Ordinance will constitute an
unnecessary hardship if applied to the property for which this special exception is
sought; and
5. The approval does not interfere substantially with the Comprehensive Plan adopted
by the City of South Bend.
SECTION IV. Approval is subject to the Petitioner complying with the reasonable conditions
established by the Board of Zoning Appeals, which are on file in the Office of the City Clerk.
SECTION V. this resolution shall be in full force and effect from and after its adopted by the
Common Council and approved by the Mayor.

The petitioned parcel is located at 3003 Lincolnway West and is the northeast corner of Terrace Avenue
and Lincolnway West. This parcel was previously used as a parking lot. The pazcel is zoned MU Mixed Use
District. The applicant, Kuert Concrete, Inc., would like this site to serve as a parking lot for their office. Kuert
Concrete is currently in the building located on the northwest corner of Terrace Avenue and Lincolnway West
in the former Mr. Moo's Restaurant. This office is in the CB Community Business District. Therefore, we ask
the Board to grant a Special Exception Use to allow parking in a MU Mixed Use District which will serve an
Office in CB Community Business District and a Special Exception Use to allow off site parking for the Ofl7ce
on the MU Mixed Use parcel. Also, seeking a parking lot setback variance from the required 20' setback to 5'
along Terrace Avenue and Lincolnway West.
The establishment, maintenance or operation of the special use will not be detrimental to or endanger the
public health, safety, morals, comfort or general welfare. We are simply utilizing existing features and/or uses.
The special use will not injurious to the use and enjoyment of other property in the immediate vicinity for the
purposes already permitted, nor substantially diminishes and impair property values within the neighborhood.
The establishment of the special use will not impede the normal and orderly development and improvement of
the surrounding property for uses permitted in the district. The parking lot currently exists; we wish to use it for.
the adjacent office space. Adequate utilities, access road, drainage and/or necessary facilities shall be provided
and approved by appropriate governing offices. Adequate measured have been taken to provide ingress and
egress so designed as to minimize traffic congestion in the public street.

The above referenced petition of Kuert Concrete was legally advertised on January 4, 2007. The Board of
Zoning Appeals gave it a public hearing on January 18, 2007, at which time the following action was taken:
Upon a motion by Mr. Mr. Hoban, being seconded by Mr. Kilbase and unanimously carried,
the petition for Special Exception of Kuert Concrete to allow parking in "NIU" to serve property
zoned "CB" and a Special Exception to allow off site parking for "CB", on property located at 3003
Lincohlway West, is sent to the Common Council with a Favorable Recommendation.
The deliberations of the Board of Zoning Appeals and points considered in arriving at the above decision as

The petition of Kuect Concrete, h1C. seeking a Special Exception to allow parking within MU-Mixed Use to
serve properly in "CB" Cotntnutlity Business; a Special Exception to allow a parking lot to be off-site parking
for "CB" Community Business; and a variance from the required 20' setback to 5' along Terrace Avenue and
Lincolnway West, on property located at 3003 Lincolnway West. This property is zoned "MU" Mixed Use.
MR. BERNIE FEENEY: Lang, Feeney & Associates, 715 S. Michigan St., South Bend. I'm here this
afternoon on behalf of Kuert Concrete. They ace the contingent purchasers on property formally known as
Mr. Moo's restaurant located at both the northeast and northwest corners of Terrace Ave. and Lincolnway
West. The physically struchu-e that Kuert Concrete is purchasing is located at the northwest corner and is the
corner restaurant lalown as Mr. Moo's. This particular piece of property will currently be used under their
current vision for that building as part of a retail facility where they will offer items for sale as well as office
space for their operations. As part of the sale of the parking lot on the east side of Terrace Ave. will be used
for parking. So consequently we are asking for a variance to allow off site parking, however in discussing this
with Area Plau and the Building Department we were informed that we needed the variance to allow parking
in the Mixed Use district to serve the Community Business zoning. So we are asking for that as well That is
the sum and substance of the entire variance and if you have any questions I'd be happy to answer them.
MR. SASSANO: Are there improvements being planned for the lot?

MR. FEENEY: Based on conversations with Mr. Fozo, Mr. Sassano there arc at this time no additional
improvements planned other than the improvements that are currently there. There are two curb cuts on
Lincolnway, The curbing along Terrace Ave, is of questionable quality but no additional improvements are
planned at this point.
MR. SASSANO: And there are no variances required for plantings or anything like that DOn?
MR. FOZO: According to the plan I'm looking at ycs there are. It says proposed landscape screening, 3
feet.. .
M.R. FEENEY: ['m so--ry, perhaps I dichl't completely understand the question then. There ace screening in

MR. SASSANO: Is it just about plantings or Is there...? My question is, it just seems to me that you could
aCCOnllllodate some green space along Lincolnway. And I'm just wondering if ...
MR. FEENEY: Certainly and that has been shown on the plan. And Kuert have already been advised that that
will be part of any improvements that they will be needing to do out there.
MR. SASSANO: Specifically I aln looking at the 20' parking setback line along Lincolnway. And you've got
two curb cuts and I'm llOt sin"e yoU heed both Of them and 170 parlClilg spaces that 111 g0% of those setbacks, so
why is that not grass? I guess I don't understand why that's not grass.
MR. FEENEY: What I was doing is utilizing what was there rather trying to convert any of the hard space.
MR.SASSANO: Hence, my question, are you going to be doing any work?
MR. FEENEY: Yes.
MR. SASSANO: Like the plantings you're gong to be putting in, are those where you're just going to be
digging a hole and sticking them in or do you have to rip up concrete anti plant sod and put curbs in?
MR. FEENEY: There maybe some concrete that has to be ripped ttp, but tt will t111t1unal.
MR. SASSANO: I'nl not trying to increase the cost of the job unreasonably but it does seem to me looking at
the drawing that more aCCO1111110C1atlonS for some of the green space in the setback could be made than are
shown.
MR. FEENEY: And absolutely Mr. Sassano and to be quite honest with you that was the thought process in
the landscaping that's shown around the exterior. We currently are showing space enough for 15 cars to park
on this particular piece of property with access off of Lincolnway. There are fences along the east and
northerly side of these two of these two lots and the remaining area can be devoted to both grass and plantings
as required by tine landscaping part of the ordinance so we are showing that yes, landscaping will have to be
done out there as part of the site plan.
MR. SASSANO: And Don do they still have to submit a plan to you?

After hearing the evidence on the petition, the Board of Zoning Appeals find that you did satisfy the
Standards as set forth in LC. 36-7-4-918.5; therefore, the petitions for Special Exception were sent to
the Common Council with Favorable Recommendations and the petition for variances granted.
Based on the testimony presented, the Board of Zoning Appeals, after carefill colisideration, finds the petition
for Special Exceptions sent to the Common Council with Favorable Recommendations and the petition for
the variances granted and will issue written Finding of Facts.
