RESOLUTION NO. 13/ 1-64S <br /> A RESOLUTION CONFIRMING THE ADOPTION OF A DECLARATORY <br /> RESOLUTION DESIGNATING CERTAIN AREAS WITHIN THE CITY <br /> OF SOUTH BEND, COMMONLY KNOWN AS AIRPORT INDUSTRIAL <br /> PARK-PHASE III LOT 5-1 TO BE AN ECONOMIC REVITALIZATION <br /> AREA FOR PURPOSES OF REAL PROPERTY <br /> TAX ABATEMENT. <br /> WHEREAS , the Common Council of the City of South Bend has <br /> adopted a Declaratory Resolution designating certain areas within the <br /> City as Economic Revitalization Areas for the purpose of tax abate- <br /> ment consideration; and <br /> WHEREAS , a Declaratory Resolution designated the area <br /> commonly known as Airport Industrial Park-Phase III Lot 5-1 <br /> and more particularly described by a line drawn as follows : <br /> A part of the Southeast Quarter of Section 28, Township 38 North, <br /> Range 2 East, St. Joseph County, Indiana , described as follows : <br /> Commencing at the northeast corner of said quarter section; <br /> thence South 89° 58 ' 56" West a distance of 1582 .51 feet along the <br /> north line of said quarter section to the point of beginning; <br /> thence South 0` 21 ' 33" West a distance of 375.00 feet; thence <br /> South 89058 ' 56" West a distance of 709 .63 feet; thence North <br /> 0600'47" East a distance of 375 .00 feet to the south boundary of <br /> Boland Drive ; thence North 81' 58 '56" East a distance of 711 .90 <br /> feet along said south boundary to the point of beginning and <br /> containing 6.119 acres , more or less. <br /> The above tract of land is subject to a drainage course right-of- <br /> way described as follows : <br /> A part of the Southeast Quarter of Section 28, Township 38, North, <br /> Range 2 East, St. Joseph County, Indiana described as follows : <br /> Beginning on the north line of said quarter section South 89 <br /> degrees 58 minutes 56 seconds West 2194.41 feet from the northeast <br /> corner of said quarter section; thence South 0 degrees 00 minutes <br /> 47 seconds West 375.00 feet; thence South 89 degrees 58 minutes <br /> 56 seconds West 80.00 feet; thence North 0 degrees 00 minutes 47 <br /> seconds East 375.00 feet to the north line of said quarter <br /> section; thence North 89 degrees 58 minutes 56 seconds East 80.00 <br /> feet to the point of beginning and containing 0.689 acres, more <br /> or less. <br /> The above tract of land is encumbered by the following easements: <br /> 1 . An easement 20 feet in width off the entire most westerly <br /> side in favor of Chicago South Shore and South Bend Railroad. <br /> 2 . An easement 50 feet in width off the entire north side in <br /> favor of Indiana & Michigan Electric Company. <br /> as an Economic Revitalization Area ; and <br />
