RESOLUTION NO. yAL-7 - RS <br /> A RESOLUTION OF THE COMMON COUNCIL OF THE <br /> CITY OF SOUTH BEND DESIGNATING CERTAIN <br /> AREAS WITHIN THE CITY COMMONLY KNOWN AS <br /> AIRPORT INDUSTRIAL PARK-PHASE III LOT 5-1 <br /> AN ECONOMIC REVITALIZATION AREA FOR <br /> PURPOSES OF REAL PROPERTY TAX ABATEMENT. <br /> WHEREAS, a petition for real property tax abatement consid- <br /> eration has been filed with the Common Council of the City of South <br /> Bend, requesting that the area commonly known as Airport Tndustr!al <br /> Park-Phase III Lot 5-1 , South Bend, Indiana , and which <br /> is more particularly described by a line drawn as follows: <br /> A part of the Southeast Quarter of Section 28, Township 38 North, <br /> Range 2 East, St. Joseph County, Indiana, described as follows : <br /> Commencing at the northeast corner of said quarter section; <br /> thence South 89° 58'56" West a distance of 1582. 51 feet along the <br /> north line of said quarter section to the point of beginning; <br /> thence South 0° 21 '33" West a distance of 375.00 feet; thence <br /> South 89° 58 ' 56" West a distance of 709.63 feet; thence North <br /> 0° 00'47" East a distance of 375.00 feet to the south boundary of <br /> Boland Drive ; thence North 89° 58' 56" East a distance of 711 .90 <br /> feet along said south boundary to the point of beginning and <br /> containing 6.119 acres , more or less . <br /> The above tract of land is subject to a drainage course right-of- <br /> way described as follows : <br /> A part of the Southeast Quarter of Section 28, Township 38 North, <br /> Range 2 East, St. Joseph County, Indiana described as follows . <br /> Beginning on the north line of said quarter section South 89 <br /> degrees 58 minutes 56 seconds West 2194.41 feet from the northeast <br /> corner of said quarter section; thence South 0 degrees 00 minutes <br /> 47 seconds West 375.00 feet; thence South 89 degrees 58 minutes <br /> 56 seconds West 80.00 feet thence North 0 degrees 00 minutes 47 <br /> seconds East 375.00 feet to the north line of said quarter <br /> section; thence North 89 degrees 58 minutes 56 seconds East 80. 00 <br /> feet to the point of beginning and containing 0.689 acres, more <br /> or less. <br /> The above tract of land is encumbered by the following easements : <br /> 1 . An easement 20 feet in width off the entire most westerly <br /> side in favor of Chicago South Shore and South Bend Railroad. <br /> 2. An easement 50 feet in width off the entire north aide in <br /> favor of Indiana & Michigan Electric Company. <br /> be designated as an Economic Revitalization Area under the provisions <br /> of Indiana Code 6-1 .1-12,1-1 , et seq. ; and <br />
