NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE <br /> CITY OF SOUTH BEND, INDIANA, AS FOLLOWS: <br /> Section I. It is in the best interest of the City of South Bend and the area proposed to be <br /> annexed that the following described real property located in Portage Township, St. Joseph <br /> County, Indiana be annexed to the City of South Bend: <br /> A part of the Southwest Quarter of Section 8, Township 37 North, Range 2 East, Portage <br /> Township, St. Joseph County, Indiana, which is described as: beginning at a point 1 foot South <br /> of the intersection of the South right-of-way line of Western Avenue extended East with the <br /> Centerline of Mayflower Road and the existing Corporation line for the City of South Bend; <br /> thence South along said Centerline and Corporation line a distance of 588.90 feet more or less; <br /> thence West along a line which is parallel to and 20 feet North of the Centerline of Vacated <br /> Huron Street and its Easterly extension a distance of 240 feet more or less to a point which is 50 <br /> feet North of the Northeast corner of a parcel of ground identified with Tax Key Number 17- <br /> 1034-095401 in the Records of the Auditor's Office of St. Joseph County, Indiana; thence South <br /> along the East line of said Parcel and its Northerly extension a distance of 200 feet more or less <br /> to the South line of Lot# 68 in the Plat of"Grouse's Addition" as recorded in the Records of the <br /> St. Joseph County, Indiana Recorder's Office; thence West along the South line of said Lot# 68 <br /> and Lot # 54 in said Plat a distance of 389 feet more or less to a point 1 foot East of the East <br /> right-of-way line of Hollywood Boulevard; thence North parallel to and 1 foot East of said East <br /> line a distance of 610 feet more or less; thence East a distance of 139 feet more or less to the <br /> Northeast corner of a Parcel of ground identified with Tax Key Number 17-1034-0928 in the <br /> records of said Auditor's Office; thence South along the East line of said Parcel a distance of 100 <br /> feet more or less to the North line of Lot # 56 in said Plat; thence East along said North line a <br /> distance of 160 feet more or less to the Southwest corner of Lot # 61 in said Plat; thence North <br /> along the West line of said Lot# 61 a distance of 269 feet more or less to a point 1 foot South of <br /> the South right-of-way line of Western Avenue; thence East parallel to and 1 foot South of said <br /> South line a distance of 330 feet more or less to the point of beginning. <br /> Section II. It shall be and hereby is now declared and established that it is the policy of <br /> the City of South Bend, to furnish to said territory services of a non-capital nature, such as police <br /> and fire protection, street and road maintenance, street sweeping, flushing, and snow removal, <br /> within one (1) year of the effective date of the annexation in a manner equivalent in standard and <br /> scope to services furnished by the City to other areas of the City regardless of similar <br /> topography, patterns of land utilization, and population density; and to furnish to said territory, <br /> services of a capital improvement nature such as street and road construction, sidewalks, a street <br /> light system, a sanitary sewer system, a water distribution system, a storm water system and <br /> drainage plan, within three (3) years of the effective date of the annexation in the same manner <br /> as those services are provided to areas within the corporate boundaries of the City of South Bend <br /> regardless of similar topography,patterns of land use, or population density. <br /> Section III. The South Bend Common Council, shall and does hereby now establish and <br /> adopt the Fiscal Plan, attached hereto as Exhibit"A", and made a part hereof, for the furnishing <br />
