RESOLUTION NO. (417-0, A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND DESIGNATING CERTAIN AREAS WITHIN THE CITY COMMONLY KNOWN AS 212 EAST LASALLE STREET AN ECONOMIC REVITALIZATION AREA FOR PURPOSES OF REAL PROPERTY TAX ABATEMENT. WHEREAS, a petition for real property tax abatement consideration has been filed with the Common Council of the City of South Bend, requesting that the area commonly known as 212 East LaSalle Street, South Bend, Indiana, and which is more particularly described as follows : Real Estate in St . Joseph County, in the State of Indiana, described as follows : Lots Numbered Four (4) , Five (5) and Six (6) as shown on the Original Plat of the Town of Lowell, now a part of the City of South Bend, excepting therefrom a lot or parcel of land 16 rods in length taken off of and from the entire width of the East ends of said lots . Also Lots Numbered Two (2) , Three (3) and Four (4) as shown on the recorded plat of Esther H. Miller ' s Subdivision of a part of Lots Four (4) , Five (5) and Six (6) in the Original Plat of the Town of Lowell, now a part of the City of South Bend. Subject to Resolutions of the City of South Bend Redevelopment Commission, rights of the United States of America, State of Indiana, the municipality and the public in and to that part of said real estate which may be covered by the waters of the St . Joseph River and to the right of the riparian owners in and to the free and unobstructed flow of the waters of said river. be designated as an Economic Revitalization Area under the pro- visions of Indiana Code 6-1 . 1-12 . 1-1, et seq. ; and WHEREAS, the Redevelopment Commission has concluded an investigation and prepared a report with information sufficient for the Common Council to determine that the area qualifies as an Economic Revitalization Area under Indiana Code 6-1 . 1-12 . 1-1, et seq. , and has further prepared maps and plats showing the boundaries and such other information as required by law of the area in question; and WHEREAS, the Human Resources and Economic Development Committee of the Common Council has reviewed said report and recommended to the Common Council that the area qualifies as an Economic Revitalization Area . NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend, Indiana, as follows : SECTION I . That the Common Council hereby accepts the report and recommendation of the Human Resources and Economic Development Committee that the area herein described be desig- nated an Economic Revitalization Area and hereby adopts a reso- lution designating this area as an Economic Revitalization Area for purposes of real property tax abatement . SECTION II . That this designation shall be limited to three (3) calendar years from the date of the adoption of this Resolution by the Common Council.
