ORDINANCE <br /> AN ORDINANCE AMENDING ORDINANCE NUMBER 1758 ADOPTED FEBRUARY <br /> 22, 1915 AND REPEALING SECTION 6 OF ORDINANCE NUMBER <br /> 1784, ADOPTED MAY 1Q,, 1915. <br /> BE IT ORDAINED by the Common Council of the City of South <br /> Bend, Indiana. <br /> • SECTION 1. <br /> That Section One of Ordinance Number 1758, being Ordinance <br /> Number 458 of a compilation of ordinances in book form known as Ordinance <br /> Number 1827 and adopted February 14, 1916, be and the same is hereby <br /> amended to read as follows, to-wit: <br /> ' Every person who shall sell, barter, or exchange, <br /> or offer for sale, barter, or exchange at retail any goods, <br /> wares or merchandise (which terms shall also include all fruits, • <br /> vegetables, refreshments, confectionery and country produces) <br /> by traveling from place to place in said c .ty and selling or <br /> offering to sell such things from a pack carried on the person 1 <br /> or from a wagon, push-cart, or other vehicle or mode or method <br /> of transportation shall be deemed a peddler and shall, before <br /> engaging in such business, obtain a peddler' s license as else- <br /> where <br /> in said Ordinance Number 1758 provided. Such peddler, <br /> • <br /> While on the streets and public places of said city, shall keep„,; . • <br /> moving from place to place save and except while.< ' gotiaY'ng a"` <br /> sales or sales. " <br /> SECTION <br /> That Section Four of said Ordinance Number 1758, being Section <br /> .461 of said Ordinance Number 1784, be and the same is hereby amended to <br />• read as follows, to-wit: <br /> uTit,w fees for licenses for such peddling for a <br /> period of one quarter shall be as follows: <br /> Pack Peddler $78.00 per period <br /> Push-cart, Wagon or Vehicle Peddlerper period <br /> SECTION 3. <br /> That Section Nine of said Ordinance Number 1758, being Section <br /> 466 of said Ordinance Number 1784, be and the same is hereby amended to <br /> read as follows, to-wit: <br /> "That the provisions of this Ordinance shall not <br /> apply to the sale of newspapers nor to the. sale of produce, <br /> vegetables, or fruits when such produce, vegetables or fruit <br /> is raised, grown and produced by the person so selling the <br /> same, nor shall the provision of this Ordinance apply to <br /> wholesale travelling merchants .who sell only to resident re- <br /> tail dealers in wholesale quantities, provided, however, that <br /> all persons who desire to sell produce, vegetables, or fruit <br /> of their own raising shall, before peddling the same apply to /�/ <br /> the City Controller and make affidavit to the effect that the <br /> produce, vegetables or Mit which he desires to sell is of <br /> his own raising and if such person fails or refuses to make <br /> such affidavit, then if he peddle he shall be liable to the <br /> penalties of said Ordinance." <br /> SECTION 4. <br /> That a new section to be known as Section 10-a of said / <br /> - 1 - <br />
